Edward Merritt, Lime Kiln Rd., Map 27 and portion of Parcel 18-Mr. Merritt was unavailable for tonight’s meeting.  His representative, Rob Akroyd of Greylock Design Associates, submitted via mail, new plans with a revision date of 11/27/12, and a request to amend the existing Order of Conditions relative to the house lot, MA DEP file number 198-0234.  Mr. Akroyd has not yet heard from Natural Heritage regarding the fence.

The Commission reviewed the newly submitted plan and concluded that the plan is lacking the wetland boundary at the top of the bank and the depiction of the ten foot non-disturbance zone.  Also, they still need to have a letter from Natural Heritage regarding the fence.

It was anticipated that the plan for the studio lot, MA DEP file number 198-0219, would have been submitted.  The plan needs to be changed to show the split rail fence rather than the stone wall.

NC will follow up with Mr. Akroyd so that it is clear what is expected at the December 20th meeting.  

Other Business:
Request to Amend Superseding Order, Lenox Woods South, formerly Aspinwell Shops, MA DEP file number 198-0233.  Jim Scalise of SK Design Group, Inc., wanted to let the Commission know that he has submitted a request to Mass DEP to amend the Superseding Order of Conditions for the proposed residential development located at 55 Pittsfield-Lenox Road.  The work was never completed, and the property has changed ownership.  The current owner, LD Associates, LLC, wishes to reduce the scope of the project.  

Mr. Scalise stated that this formal request is submitted to MA DEP, not to the local Commission.  There will be a public hearing and a 30 day period for public comment which ends January 4, 2013.  He and the applicant wanted to inform the Commission of their proposal and review their submittal to DEP.  The proposal is for a 12 unit, (3 bedrooms-2 e="+0" color="#000000" style="font-family:Times New Roman;font-size:9pt;color:#000000;">Tad Ames, President of Berkshire Natural Resources Council, submitted a Municipal Certification document for signatures of the Commissioners.  The form was signed and the original and a copy were left in the Town Clerk’s office for Mr. Ames to pick up on December 7, 2012.  Note: On December 7th, Mr. Ames stated that he only needed a copy of the Municipal Certification which he took.  The original was placed in Conservation Commission file, “Lenox Mountain CR Dec. ‘12”.  

Gail Ceresia was present to see what she could do about filing an RDA for property at 305 Walker St., Map 4 Parcel 12.  This is a vacant lot on which she said the Commission had approved boundaries in 2004.  She said that she flagged the property in August.  The Commission agreed to a site visit Wednesday, December 12, 2012 at 3:00 pm to verify the wetland boundary.  Ms. Ceresia will be submitting the RDA.  

Request for Certificate of Compliance dated December 3, 2012 for File # 198-126, Phillip Formel/Muirfield Properties LTD c/o Michael Belknap, Map 2 Parcel 16.  The final Order of Conditions was issued August 3, 1995. A Complete Certification was issued.

Approve Minutes-November 15, 2012-TF made a motion to approve the minutes and RFC seconded the motion.  The Commission voted to approve 7-0.  

RFC made a motion to adjourn and DL seconded the motion.  The Commission voted to adjourn by a vote of 7-0 at 8:40 pm.
