Staff present: Peggy Ammendola, PA

Cranwell Resorts, 55 Lee Rd:  Rob Hoogs, of Foresight Land Services, presented the request for Certificates of Compliance for six Orders of Conditions that were issued from 1995 to 2002.  Mr. Hoogs said that there had been a failure to follow up earlier on the different projects.  

The DEP File Numbers for the projects are:
198-130  Map 3 Parcel 54
198-153  Map 3 Parcels 55 & 55-1
198-155  Map 3 Parcels 55 & 55-1, partial compliance
198-171  Map 3 Parcels 55 & 55-1, partial compliance
198-178  Map 4 Parcels 54 & 74
198-187  Map 3 Parcel 54

Mr. Hoogs reviewed each of the projects and stated that the all of the work that is to be done has been completed.  Partial Certificates of Compliance were given on the above noted projects as portions of the work that had been proposed originally were determined to not be necessary.

On December 5, 2011, NC and VA accompanied Mr. Hoogs to inspect the sites and determined that they were in compliance.  

TF made a motion to issue Certificates of Compliance as requested.  DL seconded the motion and the Commission voted to approve 7-0.  

Richard Heiss, aka ClearView P&BC, LLC c/o Jonathan Epstein, 19 Sargent Brook Rd., Map 1 Lot 2 or parcel 35, Certificate of Compliance.

NC advised that he went to the site and found that the work was in compliance.  VA made a motion to issue the C of C and RFC seconded the motion.  The Commission voted to approve 7-0.

Approve Minutes: December 1, 2011-TF made a motion to approve the minutes and DL seconded the motion.  The Commission voted to approve 6-0-1.  RFC abstained as she was not present at that meeting.

Other business:
  • Edward and Gloria McMahon, letter of December 1, 2011 was received by the Commission and subsequently forwarded to the Commissioners who reviewed.  In their letter the McMahons were requesting written decisions of the December 1, 2011 meeting where the Commission determined that Jim and Carol Weber (248 Osceola Notch Rd., Map 25 Parcel 1) had not violated the Lenox SMA. Additionally the McMahons wanted the Commission to provide written confirmation that the tree cutting in fact took place in Lenox.  At tonight’s meeting the Commissioners agreed to write a letter to the McMahons stating that the Commission is not in the position to confirm the tree’s location and to include in that letter copies of the meeting minutes.  (That letter was mailed December 15, 2011.)
  • Laurel Lake-NC advised the Commissioners that the Board of Selectmen have requested that the Commission appear at their January 18, 2011 to provide input on Laurel Lake.
RFC made a motion to adjourn at 8:00 pm. DL seconded the motion and the Commission voted to agree 7-0.
