Request for Determination of Applicability, Eastover Hotel & Resort, 430 East St.  Map 13 Parcels 1 & 29.

Site visits:

Nov 27, 2010-Rob Hoogs, VA, NC, TF and JS.

Presenting the application and plans was Mr. Hoogs.  The barn, located in the south-
westerly corner of the property, is in disrepair.  It is located about 350 feet north of Sawmill Brook with wetlands located to the east and south.  Ms. Wang is not sure what she will eventually want to do with the barn, but it was determined that the first step would be to accurately delineate the wetlands and depending on what the owner decides to do, but as a minimum, the applicant requests the ability to work around the outside of barn, to replace some cribbing i.e., stabilizing the barn on a temporary basis.  This would give the applicant permission to work in the buffer zone, but not doing any work specifically in the wetland. If the work is more extensive, Mr. Hoogs said that the applicant would come back for an NOI.

JS made a motion to issue Positive 1, Positive 2A and Negative 3 Determinations.  VA seconded the motion and the Commission voted to approve 6-0.

Laurel Lake- NC informed the Commission that he has spoken with Roger Scheurer regarding the progress of the drawdown of the Lake.  Mr. Scheurer told NC that the drawdown began after the appeal period at a rate of two inches a day with a drawdown reaching approximately 26 inches.  TF said that the target drawdown of the first day of December was specified as it is assumed that the wildlife would be in their winter positions by December 1st.  Therefore, the Commission agreed that the drawdown that has been achieved of approximately26 inches is the limit.  NC will contact Mr. Scheurer tomorrow to advise him that the drawdown achieved to date cannot go any further.
(Note:  On December 3, 2010, NC spoke with Mr. Scheurer who told him that when he measured the drawdown on Wednesday, December 1, 2010, the Lake was down 30”.  NC told him to maintain the 30” for the winder.)

Minutes:  TF made a motion to approve the minutes of November 18, 2010 and DL seconded the motion.  The Commission voted 6-0 to approve.

VA made a motion to adjourn at 8:20 pm and DF seconded the motion.  The Commission voted to adjourn 6-0.
