Karen Hagley, a student of Dick Ferren was in attendance.

Notice of Intent, Birchwood Village Townhouse Association 30 Clifden Ct. & 15 Wexford Ct. Map 8 Parcel 6.  Remedial improvements associated with an existing storm water management system. Continued from April 2, 2009.

Mike Kulig of Berkshire Engineering presented the NOI.  He stated that he had received comments from Mark Stinson of DEP.  He addressed all of Mr. Stinson’s comments to the satisfaction of Mr. Stinson.  Mr. Kulig reviewed each of the comments with the Commission and presented the resulting revised site plan which shows the bank structure of the intermittent stream.  

Mr. Stinson had suggested that the Commission consider having the applicant file under Category 2, which would require a higher application fee.  As this project is a repair of onsite existing infrastructure, it was decided that the Category 1 filing was appropriate.  DL made a motion to leave as a Category 1 and grant the Order of Conditions. VA seconded the motion.  The Commission voted to agree 7-0.
 
Notice of Intent, Richard Heiss, Sargent Brook Road; Map 1 Lot 2 of Parcel 35.  Continued to June 4, 2009.

Mass Hwy, Notice of Intent 270 Main St., Map 17 Parcel 57, capping of an inactive solid waste disposal area.

Presenting the NOI were Marshall Dennis and Dave Abbott of Mass Hwy.  Details of the project and a site plan were reviewed.  A biodegradable erosion control blanket will be placed on top of the area and topped with 18 inches of low permeable soil plus 6 inches of topsoil then graded and seeded.  When asked by TF if there would be any alteration in hydrology, i.e., would it be accelerated by this project, the applicants said there would be no appreciable change.   TF requested that the infiltration rate be put into the NOI.  

The delineation will be verified by the Commission at a site visit to be conducted on April 23, 2009 at 6:00 pm.  The applicants will do a dye test to confirm the source of water coming out of a pipe which drains into the wetland area.

DF made a motion to continue the hearing to May 14, 2009 at 8:00 pm.  RFC seconded the motion.  The Commission voted to agree 7-0.


Toole Properties 2001, Inc. Notice of Intent, 439, 449 and 461 Pittsfield Rd.,  Map 50/ Map 33/ Map 33-Lot 1/ Lot 1.1/ Lot 2.  Includes work that will alleviate the historic drainage/flooding problems experienced on the project property, specifically adjacent to the southwest corner of the Yankee Inn Building.  

A site visit was conducted on April 11, 2009.  In attendance was Jim Scalise of SK Design and the following Commissioners: NC, JS, TF and VA

Presenting the NOI and a site plan with revisions noted as a result of the site visit was Scott Winters of SK Design.  

The new site plan includes a small basin adjacent to the existing 4” drain pipe plus the re-grading of the soil around the base of the building to approximately 10 feet out.  The maximum soil height at the building will be 8 inches.  

TF asked that the delineation be revised to show the wetlands boundary ten feet from the building at the west end of the building.  

VA made a motion to continue the hearing to May 14, 2009 at 7:45 pm. JS seconded the motion and the Commission voted to agree 7-0.


Other Business
        Minutes: RFC made a motion to approve the minutes of April 2, 2009 and DL seconded the motion.  The Commission voted to agree 7-0.

        Laurel Lake:  A list of additional information required for the NOI filing is being prepared to send to LLPA prior to the June 1, 2009 meeting.

        Beaver Funding:  Letter that was received by the DPW requesting assistance for funding was read.

        Lenox Gateway:  A letter from Robert Fournier of SK Design has been received requesting a three year extension on their Order of Conditions.  NC and VA will go to the site to see if any of the required conditions of the six month extension set to expire on May 15, 2009 have been met.

        Site Visit:  Schweitzer Mauduit, Intl., Niagara Mill on April 23, 2009 at 5:30 pm.
