Notice of Intent ,Terry and Bonnie Burman, 40 Brunell Ave., Map 42 Parcel 28-30, construction of a driveway and associated utilities within the 100’ buffer zone as well as replacement of a failed drainage culvert that crosses an intermittent stream. Continued from September 18, 2008 as the Commission had not received a File Number from DEP. Continued from October 2, 2008.

Nick Andersen of Berkshire Engineering, standing in for Mike Kulig, brought a new plan and revisions to the original NOI.  The Commission reviewed each revision and was pleased that all changes requested had been made.

TF made a motion to approve as revised and VA seconded the motion.  The Commission voted to approve 6-0.

7:45 pm ANRAD, Price Chopper Shopping Center, 489 Pittsfield Rd., Map 33 Parcel 4.

Presenting the ANRAD was Anne McMenemy, Tim Williams and Jeff Heidelberg.  
A site visit was attended by Anne McMememy, NC, TF and RFC on October 11.  On October 12 a site visit was attended by NC, JS and VA.

Ms. McMenemy reviewed the delineation and noted that there are four wetland systems, each having less than ? square miles of watershed.  

As a result of the site visit minor revisions to the map have been made, joining the east and west wetlands even though they drain in opposite directions. It was decided after some discussion at tonight’s meeting to note on the map the northern boundary of the wetland by joining two flags.

TF noted that contour lines were not shown into the wetlands.  Ms. McMenemy explained that this detail would be shown on the NOI where construction might impact these areas.

A Map was presented that noted the proposed locations for test pits and borings. The Commission felt that the extensive silt control measures shown would not be necessary, instead preferring tape which indicates the edge of the wetlands to ensure that machinery would not enter this area.   The Commission requires that the test pits are to be refilled, compacted and reseeded when work is completed.  It is expected this work will take one week.  NC is to be called when the work commences.  It was suggested that the contractor be given specific written guidelines to be followed to protect the wetlands, and that the same guidelines be provided to the Commission.  Additionally, the contractor is to be advised to have contingency plans in the event conditions arise that are conducive to erosion.

The file number from DEP has not been received; therefore the meeting would have to be continued.

JS made a motion to continue to November 6, 2008 at 7:30 pm and RFC seconded the motion.  The Commission voted to agree 6-0.

Other business:
1.      Housatonic River Initiative-A meeting is slated for October 21, 2008 at 7:00 pm at the Town Hall.

2.      Hampton Inn, Mollie Way-Letter received from SK Design that stated that the firm had completed the inspection for the replication and that the plantings were growing.  NC advised the Commission that he had gone to the site in the past few days and found that the drainage pipes are not in the correct location and will notify the responsible parties.

3.      Post Farm at Willow Creek Rd.  The Commissioners noted that there has not been a resolution to the logs blocking the access to Post Farm at this location at East Street.  The Commission received complaints about the lack of access earlier this year and subsequently had Town Counsel determine that the Town had the right to access at this location and Town Counsel would write letters to the abutters and send a copy of the letter to the Commission.  It was determined that the Commission would advise the Town Manager, Greg Federspiel, of the lack of action.

4.      Minutes of October 2, 2008-TF made a motion to approve the minutes and VA seconded the motion.  The Commission agreed to approve 6-0.  

5.      Woods Pond-PA advised the Commission that Cris Roberts, the Administrative Assessor, has not been able to determine the ownership of the parcel.  She has checked with the company who compiles the records and they have said that they do not have archives.  Cris will look further into the deeds to try to determine ownership.

6.      Conservation Commission funds-PA was asked to check with the Town Accountant to see what money is available.  The Commission would like to have gates to block vehicles from Post Farm.  

RFC made a motion to adjourn and TF seconded the motion.  The meeting was adjourned at 9:30 pm.
