Land Use Meeting Room
Members present:

Notice of Intent, Terry and Bonnie Burman, 40 Brunell Ave., Map 42 Parcel 28-30, construction of a driveway and associated utilities within the 100’ buffer zone as well as replacement of a failed drainage culvert that crosses an intermittent stream. Continued from September 18, 2008 as the Commission had not received a File Number from DEP.
Michael Kulig of Berkshire Engineering was present. The File Number and comments from DEP have been received. The Commission reviewed with Mr. Kulig each of the comments and discussed required revisions to the NOI and plan that had originally been submitted. Mr. Kulig agreed that he will send the revisions and full site photo to Mark Stinson of the DEP and then follow up by emailing to PA the same documents. He will bring the new plan to the next meeting. JS made a motion to continue the meeting to October 16, 2008 at 7:30 pm and DF seconded the motion. The Commission voted to agree 7-0.
Notice of Intent, Richard Heiss, Sargent Brook Road; Map 1 Lot 2 of Parcel 35. Continue to mow an existing 6’ wide grass path through the buffer zone and BVW to Laurel Lake; mow a 12’ by 12’ sitting area; install a boat rack, 2 pipes for attachment of removable floating dock, weed-whack parcel two times a year and remove invasive shrubs. Continued from August 21, 2008, September 4, 2008, and September 18, 2008. RFC made a motion to continue to Nov. 6, 2008 and DL seconded the motion. The Commission voted to agree 7-0.
Notice of Intent, Mass Highway 270 Main St., Map 17 Parcel 57. Capping of an inactive solid waste disposal area. Continued from August 7, 2008, August 21, 2008, September 4, 2008, September 18, 2008. (Originally on the April 17, 2008 agenda.) VA made a motion to continue to November 6, 2008 and TF seconded the motion. The Commission voted to agree 7-0.
Other business:
Post Farm: NC told the Commissioners that he had received a call from a Mr. Speyerer regarding the boulders that are placed to block the road to Post Farm. Mr. Speyerer wanted to have access to the Housatonic River to launch his canoe. NC explained that trucks had been destroying the woodlands and the boulders were put in place to prevent further destruction.
Minutes September 16, 2008: RFC made a motion to approve the minutes and TF seconded the motion. The Commission voted to approve 7-0.
Woods Pond: RFC told the Commissioners that she kayaks on Woods Pond and launches from the west bank at the pedestrian bridge. She reports that people have been putting materials such as wood pallets and tires on the shore to be able to access the pond. It is very muddy and these materials eventually settle into the mud. She wanted to know what could be done. The Commissioners reviewed tax assessor’s records and maps to try to determine who owned the property. The parcel was identified; however there are no tax records for this property. PA will ask the Administrative Assessor to assist in determining ownership.
Ed Merritt: NC told the Commission that Mr. Merritt has left piles of fill that need to be removed from the property and the silt fence needs to be re-done. DL said that he felt that it is possible the fill is to be used in putting in the septic system and that it appears to be stable. DL will speak to Mr. Merritt and report back to the Commission.
