Members present:

6:30 pm RDA, Town of Lenox-reclaiming and repaving of some streets within the town.  There is no excavation other than reclaiming of the existing pavement. There will be no pipe excavation.

Jeff Vincent, DPW Superintendent, who was present to submit the request, stated that this is similar to the project in 2004, but a little more intensive.  Thirteen streets are scheduled to have work done.  The black top will be reclaimed.   The reclaimed product will be used as a base for the new surface.  The work is limited to surface and curb work.  Some gravel will be brought in for some sections of roads where the existing base is a little soft.  Hay bales will be placed as needed.

DL made a motion to approve the RDA with a Negative III Determination.  RFC seconded the motion and the Commission approved 6-0.

Notice of Intent, Mass Highway 270 Main St., Map 17 Parcel 57.  Capping of an inactive solid waste disposal area. Continued from August 7, 2008.  (Originally on the April 17, 2008 agenda.)  Pending delineation.

VA made a motion to continue to the next meeting.  JS seconded the motion and the Commission agreed 6-0.


Neal advised the Commission of the following upcoming agenda items:
1.      Request for Determination of Applicability, Jennifer Sagalyn 40 Sargent Brook Road, Map 1 Parcel 29.  Construction of a 10 foot by 12 foot shed.  
2.      Notice of Intent, Berkshire Natural Resources Council, Hallowell Meadows, East St., Map 4 Parcel 29.  Hiking trail.
3.      Notice of Intent, Richard Heiss, Sargent Brook Road, Map 1 Lot 2 of Parcel 35.  Continue to mow an existing 6’ wide grass path through the buffer zone and BVW to Laurel Lake; mow a 12’ by 12’ sitting area; install a boat rack, 2 pipes for attachment of removable floating dock, “weed-wack” parcel two times a year and remove invasive shrubs.  
Site visits were scheduled for these items on Thursday, August 14, 2008.

Other business:
Flooding on Walker Street in Lenox Dale:  NC advised the Commission that he met with Gerry Kelly of Walker Street at a meeting of concerned citizens regarding the recent flooding on Walker Street during heavy rain storms.  Approximately 20 residents, DPW Superintendent Jeff Vincent, and Selectmen Roscoe Sandlin and Linda Messana attended.  NC said that a part of the problem is an area at the site of the 13th Fairway at the golf course at Cranwell, but the larger problem would require the Town of Lenox to put in a pipe that would drain into the Housatonic River.    

Recently the Commission sent a letter to Cranwell and Rob Hoogs of Foresight Land Services regarding the problem at the 13th Fairway.  Jack Punta, a representative of Cranwell, called NC and they have agreed to meet at the site of the 13th Fairway to discuss what might be done to help with the silting that is occurring behind Jedd Hall’s home at Walker St.  The Commission would like to see if Cranwell will work with the Commission to correct the problem at the 13th Fairway.  Remediation at this location would help with the flooding somewhat.  

Mr. Vincent will continue to work with the residents and NC said that he will go meetings that this group may schedule in the future.     

The Commission continued their discussion regarding the Cranwell issue.  NC researched old Commission files and found a design file for detention pond #4 which is the area of the 13th Fairway.  (The reference number for this file is D-1, Job # E-496A, dated March 20, 1985)  It appears that the pond was built according to the design.

Lenox Gateways:  JS submitted a copy of a letter he sent to Natural Heritage regarding mowing that has been done in a restricted area at Lenox Gateways, 55 Pittsfield Road.  PA will make minor changes and submit the letter to David Case and Jim Scalise of SK Design.  (This was completed on August 13, 2008 and a copy of the letter in file.)

Community Preservation Committee: JS told the Commissioners that the CPC will have a meeting regarding open space on August 25, 2008 at 7:30 and encouraged those who are interested to attend.

Minutes of July 17, 2008:  TF made a motion to approve the minutes and VA seconded the motion.  The Commission voted to approve 3-0-3.  The three who abstained, RFC, JS and DL, were not at that meeting.
