Notice of Intent, Mass Highway 270 Main St., Map 17 Parcel 57, capping of an inactive solid waste disposal area.  Continued from June 5, 2008.  The applicant, at the May 29th site visit had agreed to re-flag the location as previous flagging was no longer visible.  A follow up site visit was on June 16th, but due to adverse weather conditions, it was rescheduled to June 18.  Attending that site visit was NC, TF, JS and DF.

Presenting the NOI was David Abbot of Mass Highway and John DePaolo, Environmental Engineer with Fuss and O’Neill.  

Mr. Abbot told the Commission that this project involves a self disclosed land fill.  It has been ongoing since 1999-2000 and under DEP scrutiny during the process. Obtaining the Order of Conditions would be the final step in this process.

Mr. DePaolo described the project.  The land fill is made up of “street sweeping”, solid waste which consists of broken concrete, asphalt, etc.   The area, about ? of an acre, would be re-graded and topped with a layer of low permeably soil (prevents run-off), six inches of topsoil and then grass.  It would function as a normal grass field.  After the project is completed, the area would be off limits for any use.  Mowing would occur perhaps once a year.  

The Commission noted that the recent flagging at the site did not coincide with the flagging on the plans submitted with the NOI.  Discussion ensued regarding the best way to proceed, i.e., re-delineate or have the new flags in the field and on the plan be numbered consecutively.  

The Commission also discussed how to proceed with a stormwater report under the guidelines of Stormwater Management.  It was suggested that the Commission would wait until DEP issues a file number.  Though the consensus was that since a point source is not being created, a report would not be required.  An explanation as to why the report was not necessary should be on the Order of Conditions.

The Commission discussed a 30 inch pipe that is in the lower area of the landfill.  It appears to be active, but no one seems to know the source or the direction of the pipe.  Mr. Abbot agreed to check with Jeff Vincent of the Department of Public Works.  

The Commission requested of Mr. Abbot that all of the debris that appears to have been pushed into the toe of the landfill, be put back into the land fill area before the capping.  They also requested that trees be planted at the edge to serve as a buffer to the wetland.  

TF questioned if the capping of the landfill would alter the hydrology and would the impermeable landfill cap reduce infiltration and accelerate runoff to the wetland.~ TF also noted that there was no documentation of hydrologic changes nor a stormwater management report included in the NOI, therefore the Conservation Commission is not able to conclude that the wetland will not be altered.  Mr. Abbot said that because there is a no point source discharge a stormwater management report is not required.

RFC made a motion to continue the hearing until July 3, 2008 at 7:30 pm.  DF seconded the motion and the Commission voted to agree 7-0.

Other business:
·       Minutes of June 5, 2008-RFC made a motion to approve the minutes with edits.  DF seconded the motion and the Commission voted to approve 7-0.
·       CPC funds-JS reported that Post Farm met certain criteria for CPC funds and suggested that the Commission put in a trail system, parking lot on East Street entrance and possibly a rifle range.  Discussion ensued regarding his suggestions.  There are existing trails.  There is a road at this location; however erosion has left four foot gullies.  DL feels that with proper materials this could be corrected.  It is felt that a rifle range would be a liability to the town.
·       40 Sargent Brook, Map 1 Parcel 29, Sagalyn.  NC was contacted by Paul Gardino regarding the removal of the silt fence as a result of an RDA filed last fall.  NC went to the site and approved or the removal.
