Members present:

Request for Determination of Applicability filed by Jedd and Sandra Hall for property located at 474 Walker St., Map 39 Parcel 25.  The proposed project is for the construction of a foundation and 24’ X 28’ barn within the 100 foot buffer zone. (There was a site visit with Mr. Hall on April 24, 2008 to look over the site and review the location of the proposed barn.  Commissioners present were NC, JS, TF, DL, and VA.)
Making the presentation was Jedd Hall.  He presented a site plan which indicates the location of the proposed barn.  The area is in the buffer zone.  He said that the topography would not change.  NC asked that any fill removed with this project be removed from the site and JS asked that no herbicides be used in the back yard.  RFC made a motion to make a Negative 3 Determination and DF seconded the motion.  The conditions are as follows:  
1) Erosion control to be inspected by the Lenox Conservation Commission before work commences.
2) No herbicides to be used in the back yard.
3) No change in topography around barn or in buffer zone.
The Commission voted to agree 6-0.  DL arrived after presentation.

Notice of Intent filed by David Ferry for property located at 91 East St., Map 8 Parcel 57.  File number assigned is WE 198-0235.  The proposed project is for the construction of a two car garage, addition and landscaping.  Presenting the NOI were Don Ferry and David Ferry.  David Ferry owns the property.  Don Ferry submitted and described the site layout plan.  The work proposed is the discontinuation of the gravel driveway that goes around the house; the removal of the existing house foundation and installation of a new concrete foundation; the addition of a two car garage on the north side of the house, the removal of the existing screen and construction of a new addition on the south side of the house.  The existing septic system will be removed and the single family home will connect to the town sewer. TF made a motion to approve the NOI and issue the Order of Conditions with the following special conditions:
1) Mistake was made on the NOI.  All work is in the buffer zone. Proposed alteration in the BVW should read “O” not 6,000. (Refer to WPA Form 3, page 2, B.2.b.  Corrected page 2 will follow.
2) No herbicides to be used in back of house.
3) No mowing beyond the BVW line.
4) Before work commences, erosion control will be in place and inspected by the Conservation Commission.
VA seconded the motion and the Commission voted to approve 7-0.

Minutes of April 17, 2008: RFC made a motion to approve the minutes with two edits and JS seconded the motion.  The Commission voted to approve 7-0.
Clean Up Day:  DL reminded the Commission of the clean up effort for October, Bear Town and Lenox Mountains on May 17, 2008 at 8:30 p.m.
Shakespeare and Company: Rob Hoogs of Foresight Engineering contacted NC after the meeting of April 17, 2008 to get approval to do the maintenance (cleaning) of the detention basins while doing other work. NC contacted the Commissioners who all approved.  NC advised Mr. Hoogs to proceed.
Richard Heiss of 35 Sargent Brook Road contacted NC to see if he could extend his lawn.  NC and TF went to the sight and determined that the Lenox Conservation Commission did not have jurisdiction as this is a small isolated wetland. The work proposed was to remove scrub brush to become lawn.
