The Stormwater Management Regulations Workshop by DEP scheduled for tonight was cancelled on January 16, 2008 due to inclement weather. Mark Stinson of DEP has offered to reschedule at the Commission’s convenience. It was decided that there are three possible dates for postponement:
February 28, 2008
March 13, 2008
March 20, 2008
(It was later discovered that the auditorium has already been reserved for March 13.)
PA will notify Mr. Stinson of the two dates.
The March 6, 2008 meeting has been cancelled because there will not be a quorum.
Terry Burman, Brunell Ave., Map 42, Parcels 28 and 30, RDA to determine the classification of the resource area and if it is subject to the Wetland Protection Act.
There was a site visit on Saturday, January 12, 2008 and was attended by: NC, VA, JS, TF and Rob Akroyd of Greylock Design.
Leah Daignault of Greylock Design presented the application.
The Commission stated this is not an approval of any wetland resource boundaries, and that the stream located near the north side property boundaries is intermittent.
JS made a motion to make a Positive Determination, Number 1. VA seconded the motion and the Commission approved 6-0.
Minutes: December 20, 2007. TF made a motion to approve the minutes and VA seconded the motion. The Commission approved 6-0.
David Ferry, 857 East Street, Map 8 Parcel 57. The owner of the property is requesting permission to clear brush at the north corner of the property at East Street. The Commission consented. An NOI will be filed for a proposed driveway.
Cliff Van Reed, West Dugway Road, Map 22 Parcel 7: NC received a request from Mr. Van Reed that the Conservation Commission sign off on the project. NC advised him that the driveway has not been done as agreed and that Jeff Vincent, Supt. of the DPW is aware of this fact as well. The driveway, 12’ wide, 622 foot long, has not been completed yet, but the Commission feels that when it is, the water will drain across the roadway. (Mr. Van Reed had filed an RDA which received a Negative 3 Determination with conditions on June 7, 2007.)
David Case, Lenox Gateway, LLC, NOI for property located at 55 Pittsfield Rd, Map 17 Parcel 40.~ Mr. Case last appeared before the Commission November 15, 2007. At that hearing, the Commission denied the NOI. Mr. Case has appealed and the DEP has scheduled an informal site visit that is to take place on January 24, 2008 at 11:00 AM.
The Commission reviewed the appeal and generally thinks that the statements made are a distortion of what the Commission told the applicant and Jim Scalise of SK Design.
RFC made a motion to adjourn and TF seconded the motion. The Commission agreed
6-0.
