Members present:

7:30 pm Hashim, Request for Abbreviated Notice of Resource Area Delineation, Acquisition Trust, LLC, formerly known as Land Acquisition Trust, LLC,Pittsfield-Lenox Rd., Map 17 Parcel 41. Continued from September 20, 2007, Oct. 4, 2007 and October 18, 2007.

Present at tonight’s meeting were: Dan Nitzsche of Bay State Environmental; Rob Akroyd and Paul Tesoniero of Greylock Design Associates.

There was a site visit Friday, October 26, 2007 at 2:00 pm.  The following were present:

·       Emily Stockman, a wetland consultant

The site visit was 3.5 hours in duration.  Rob Akroyd and VA left early.

Mr. Nitzsche presented a map, dated October 31, 2007 with the revised delineation and new text, both of which reflect the changes that everyone agreed upon at the site visit.  He noted that there are no new resource areas and expansions were done in a couple of areas.  

TF made a motion to approve the revised delineation dated on October 31, 2007 with one condition and VA seconded the motion.  The Commission voted to approve the Abbreviated Notice of Resource Area Delineation 7-0.

8:00 PM David Case, Lenox Gateway, LLC, NOI for property located at 55 Pittsfield Rd, Map 17 Parcel 40.  The proposed project is construction of 40 unit townhouse development with associated site improvement, upgrade of existing detention basin, construction of screen room, demolition of a  portion of building and remaining items under File #198-0217.

Mr. Scalise said that this is a continuation of a previously approved application. (File # 198-0217)  He explained that a property cannot have two Notices of Intent at the same time or two Orders of Conditions at the same time.  Therefore, for the proposed work, the Conservation Commission must give a Certificate of Compliance on the work already completed.  The remaining work on the original NOI would be included on the new NOI. Mr. Scalise said that this procedure is mandated by the current DEP regulations.  

NC stated that he would seek guidance from Mark Stinson of the DEP.  

Mr. Scalise detailed the partial demolition and reconfiguration of the back building, referred to as Building #12, and the parking area.  He then presented the site plan for the new proposed project which includes the 40 unit housing development.  

Mr. Case said that he wants to build 11 affordable, according to the Commonwealth’s definition, housing units.  The lower end is projected to cost approximately $100,000.00 and the higher end approximately $300,000.00.  

The Commission determined that a site visit would be held on November 10, 2007 at 9:00 AM.  Mr. Scalise will flag the line of work and the center lines of the roads.

DF made a motion to continue the meeting to November 15, 2007 at 7:45 PM and JS seconded the motion.  The Commission agreed 7-0.

Other business:
·       JS, a member of the CPA committee, asked the members of the Commission to think about and report back at the next meeting on possible acquisition of properties that will enhance the Town’s open space.
·       Minutes of October 18, 2007.  RFC made a motion to approve the minutes and JS seconded the motion.  The Commission approved 7-0.
