Members present:

7:30 p.m. NOI, Canyon Ranch, 165 Kemble St., Map 3 & 7, Parcel 50 & 43.  Proposed five building, 10 unit condominiums.  Continued from July 5, 2007.
As a result of concerns the Commissioners voiced at the last meeting, Mr. Rob Hoogs of Foresight Land Services revised the plans and presented them at tonight’s meeting.  The buildings have been rotated approximately 35-45 degrees, the path has been removed and the road has shifted, but the general basic concept has remained the same.  The storm water basin was pulled back and will become a wetland garden.  There will be ten rain gardens for the ten units.  The reconfiguration of the site assures that the project will be outside of the wetlands and buffer zone.

Don Roy, the only abutter present, asked questions of Mr. Hoogs regarding runoff and commented that he was satisfied with the project.

NC noted for the record that he and DL participated in a site visit.  

DL made a motion to approve the revised plan and DF seconded the motion.  The Commission approved 7-0.  

Joe Toole, Hampton Inn, 439 Pittsfield Road, Map 33 Lot 1.  Joe Toole spoke informally with the Commission regarding his project, the Hampton Inn.    He stated that he has just become aware of the location of a detention basin-a location he feels is neither safe nor attractive and asked the Commission to permit this detention basin to be moved.  The Commission informed Mr. Toole that he would have to formally resubmit revised plans and follow the process.

Notice of Intent, DJ Oil Express, 18 Crystal Street, Map 4 Parcel 73.  The proposed project is to replace oil tanks and improve oil spill prevention and containment system and municipal sewer connection.  Continued from June 7, 2007. Continued from June 21, 2007.  Continued from July 5, 2007.

Brent White of White Engineering returned to present a storm water model and suggested conditions for the Order of Conditions.  

Mr. White told the Commissioners that he has established communications with the railroad which is the first step in the process to getting permission for the sewer connection.

Mr. White said that the stormceptor model DJ Oil has selected will “over achieve” the requirements.  The flow into the river will increase, but it will be 91 percent cleaner than the existing flow.

The contingency plan, to be used only if necessary, was detailed.  This would be a 4,000 square foot gravel lined pond with a permeable liner of 115 mil thickness that will stop hydrocarbons but allow water to pass and is acceptable to the EPA.  

TF asked that Mr. White provide some documentation that oil could not penetrate the liner.  Mr. White said that he would.

An updated (July 13, 2007) facility plan and spill prevention plan were presented.  

DL made a motion to approve the NOI as presented with conditions. JS seconded the motion.  The Commission approved 7-0.
