7:30 p.m. NOI, Canyon Ranch, 165 Kemble St., Map 3 & 7, Parcel 50 & 43. Proposed five building, 10 unit condominiums. Work within buffer zone.
Presenting the NOI was Rob Hoogs of Foresight Land Services. Also in attendance was Reggie Cooper, manager of Canyon Ranch. Mr. Hoogs gave an overview of the project and stated that when the Commissioners met with him at a site visit it was determined that there was another wetland that had not been flagged. Since that time, this wetland, at the lower playing field has been flagged. The site plan submitted at this meeting indicated a drainage concept with a number of low impact techniques to avoid altering any wetlands. The roads will be 20 feet wide and the driveways will be 12 feet wide. There will be an open drainage system with no curbs that will be managed by water quality swales and rain gardens. The soil will be amended and the plants chosen will be able to adapt to a large
range of conditions.
Mr. Hoogs promised more detailed plans if the Commissioners are satisfied with the concept. He says that the system is over designed. In response to observations by the Commissioners at the site visit, the storm water basin has been moved out of the wetlands and the project will stay out of the trees. He says this project as presented would not alter any wetlands and would retain the wooded buffer into the wetlands. He feels that this project meets all regulations and exceeds the Wetland Protection Act.
The Commissioners want Mr. Hoogs to consider moving the project further north. Mr. Hoogs will re-examine, but stated that the grade is a good reason the buildings can’t be moved. He also cited that the owners want to keep the mansion and great lawn in tact and the abutters have protested placing the project in a location that would be more visible.
DF requested a covenant so that property cannot be further developed.
JS made a motion to continue the hearing to July 19, 2007 at 7:30 p.m. and DF seconded the motion. The Commission agreed 6-0.
8:00 p.m. NOI, William and Beverly Rudge III, 22 Sargent Brook Rd., Map 1 Parcel 34, septic system upgrade. Presenting the NOI was Marc Lavasseur of Foresight Land Services. Most of the lawn is in the BVW and the sight is tight. The septic system has failed and the replacement will improve the resource area. It has been determined that the existing tank has a leak. It will either be waterproofed or by-passed.
The Commission asked that a temporary tank be placed on the site so that when construction is underway, should the excavated site fill with water, it will be pumped into the temporary tank and permitted to overflow by gravity slowly on ground.
Mr. Levasseur will send a new plan to the Commission.
DF made a motion to accept the NOI and VA seconded the motion. The Commission approved 6-0.
8:30 p.m. Notice of Intent, DJ Oil Express, 18 Crystal Street, Map 4 Parcel 73. The proposed project is to replace oil tanks and improve oil spill prevention and containment system and municipal sewer connection. Continued from June 7, 2007. Continued from June 21, 2007
Brent White of White Engineering presented the NOI and a revised set of plans which included a new design for the tank installation. Additionally he made the changes that were requested by the Commission during the site visit of May 26, 2007.
Mr. White reviewed with the Commission the sequence of events and the timeline to make the facility compliant with the EPA requirements. During the upgrade DJ Oil wishes to continue to operate.
NC asked Mr. White to upgrade the storm water collection system.
On the plans submitted tonight a temporary containment area was depicted in front of the three 10,000 gallon tanks which are located north of the new tank installation. This containment was not acceptable by the Commission. (This temporary containment would be necessary only in the event the completion date of November 1, 2007 could not be met.)
Mr. White will return to present a storm water model and suggested conditions for the Order of Conditions. The hearing was continued to July 19, 2007 at 8:15 p.m.
Minutes: June 21, 2007. DF made a motion to approve the minutes and JS seconded the motion. The minutes were approved 6-0.
DF made a motion to adjourn and JS seconded the motion. The Commission agreed 6-0. The meeting was adjourned at 10:35 p.m.
