Members present:

7:30 p.m. NOI, Barry and Carla Davis, 16 New Lenox Rd., Map 49 Parcel 9, Reconstruction of a single family home.  Continued from April 19, 2007

There was a site visit on April 26, 2007.  Present were NC, VA, DL, JS, TF and Michael Kulig of Berkshire Engineering.

Present at this meeting were Mr. Kulig and the applicants, Mr. and Mrs. Davis.

There is an existing single family home that is owned by Mrs. Davis’s grandmother.  The home is in disrepair and the Davis family wishes to demolish the structure and rebuild a larger home.  

Debris on the property will be removed and an area of mitigation will be established to offset the loss of land by the increase in the footprint of the new structure.  Planting of native trees will be within 100 feet of the river.

DL made a motion to issue the Order of Conditions and JS seconded the motion.  The Commission agreed 7-0.

Present at tonight’s meeting was Mike Kulig of Berkshire Engineering; Jim Scalise and Sarah Schultz of SK Design.

Ms. Schultz presented an up to date revision which overrides the April 27, 2007 memo.  This revision addresses three major concerns:
1.      Conservation Restriction
2.      Drainage behind buildings #9 through #12
3.      Location of sewer force main.

NC told the Commission and abutters present that he had spoken with Jeff Vincent of the DPW regarding the placement of the sewer main.  The location will be four feet into the road bed, placed so as to not be detrimental to the tree line.  This location enables the placement of the manhole covers in the center of the lane thus avoiding contact with vehicle wheels.

Jim Scalise gave a brief review of the wording for the Conservation Restriction and then reviewed at length the revisions suggested by the Commission at previous meeting.  

Discussions centered on the revised plans.  It was thought that the revision possibly would not provide enough water to maintain the wetlands in the current state.  It was suggested that the infiltrators from units 14, 15 and 16 be piped under the swale to provide water to the southern portion of the wetland.  It was further suggested that the pipe leading from the stormceptor to the level spreader be perforated to provide additional infiltration for ground water.  This idea was discussed in detail.

Abutters, particularly those on Brown Street, expressed apprehension about any development of this property exacerbating the existing drainage issues.  The Commission’s responsibility is to protect the wetlands, and the engineers want to design a stormwater system which would not add to the drainage issues, but maintain the wetlands.  A resident suggested a bond be required as protection to their property i.e., that if the conditions worsen, the residents would have recourse.  The Commission said that there could be natural causes for a possible increase in the severity of flooding.

One resident asked if she could tie into the sewer system that will be constructed for the project.  The answer was that she could do so at her own expense.

Mr. Scalise said that he would re-examine the methodology for evaluating site hydrology  and to revise sub water shed maps.  He wants to keep the project moving forth.

DF made a motion to continue the hearing to June 7, 2007 at 8:15 pm.  DL seconded the motion and the Commission agreed 7-0.

Other Business:
·       Site Visit-May 21, 2007 at 5:30 pm at Haddad Motors, Pittsfield Road.
·       Minutes:
April 19, 2007 RFC made a motion to approve as amended and DL seconded the motion.  The Commission approved 7-0.
May 10, 2007 DL made a motion to approve the minutes and VA seconded the motion.  The Commission approved 7-0.


·       Extension of Order of Conditions:  Rob Hoogs of Foresight Land Services had asked for an extension for an Order of Conditions for Haddad Motors, but it had been discovered the original extension had not been recorded at the Registry of Deeds.  The Commission signed an extension, had notarized and submitted to Mr. Hoogs at this meeting.  He intends to record this at the Registry on May 18, 2007.

RFC made a motion to approve a new Extension of Order of Conditions and sign it with the stipulation the delineation is approved and old extension is recorded in time.  DL seconded the motion and the Commission agreed 7-0.
