(Also attending tonight’s meeting was Vince Ammendola.  He has expressed an interest in becoming a Commissioner and has also attended the meetings of Feb. 15 and March 1, 2007 meetings.)

7:30 p.m. RDA filed by Dan Hunter for property located at 18 Crystal St., Map 4 Parcel 73. Replace existing oil storage tanks (DJ’s Oil Express) and upgrade spill protection.  Brent White of White Engineering was present to discuss the application.   (There was not a quorum for this meeting.  NC advised Mr. White that because he had not been aware that this RDA had been filed, there was no site visit prior to this meeting.  However, after reviewing this application, it was determined that there was substantially more involved in this request and that an NOI should be filed instead. Mr. White agreed to file an NOI.  He will submit the application no later than April 5, 2007(to meet the deadline for publication of the notice in the newspaper) and comply with requirement to notify of abutters anticipating a public hearing at the April 19, 2007 meeting).

Toole Project, Hampton Inn, Map 33 Parcel 1:  NC reported that a spokesman for this project contacted NC to say that they are aware that parts of the fencing required by the CC were down and that as soon as the snow melts and weather permits, repairs will be made.

Scenic Mountain Act:  TF had a copy of the Scenic Mountain Map for review.  PA read a memo dated June 3, 2005 addressed to Greg Federspiel from Mary Ellen Deming.  The memo detailed a conversation between Attorney Sally Bell and Mary Ellen and the process for the adoption of the Scenic Mountain Act.  The Act was first brought to Annual Town Meeting in 1976 and then again in 1985.  Draft regulations and a boundary map needs to be produced and accepted by the Board of Selectmen.  PA will look at the records for the ATM of 1985 and provide to the CC what the citizens were approving.  

Town Properties:  PA advised she has attempted to get copies of the deed restrictions for properties managed by the Conservation Commission.  These records (for anything after 1955) are available in the Assessor’s office, but they are filed by Map and Parcel number.  PA provided the Commissioners with all properties by Map and Parcel numbers and corresponding maps that are currently owned by the Town of Lenox. (There were fifty eight as of the Tax Record available on 3/15/2007.)   The Commissioners determined from that list the following properties of concern to them.  They are:
1.) Taylor, Under Mountain Road, Map 11 Parcel 12
2.) Parson’s Marsh, Map 11 Parcels 10, 17, 18 and 20.
3.) Post Farm, Map 13 Parcels 2 and 15
4.) Edith Wharton (Laurel Lake) Map 1 Parcel 41
5.) Romeo, (Taradale Realty) located behind Caligari Hardware, Map 8 Parcel 6 and 6-3

PA will use this information and submit a request to the Assessor’s office.  (This was done March 16, 2007.)

Minutes:  The minutes of Feb. 15 and March 1, 2007 were presented but because there was no forum they were not approved.  They will be submitted at the next meeting.
