Members present:  Chair Neal Carpenter, NC; Joe Strauch, JS; Rose Fitzgerald Casey, RFC; David Lane, DL; Dick Ferren, DF; Tim Flanagan, TF

7:30 p.m. RDA-Cliff Van Reed for property located on West Dugway Rd. (Map 22 Parcel 7).  The proposed project is for the installation of a new septic system and a 12’ wide, 622 foot long driveway. Continued from Jan. 4, 2007.  Continued from Jan. 18, 2007 as there was not a quorum.

Making the presentation was Leah Daignault and Rob Akroyd of Greylock Design Associates.

Ms. Daignault gave a brief history of this project.  Mr. Van Reed who owns property on the southern side of West Dugway Road filed an RDA in February 2004, for a driveway that would come in on the north east side of the property.  The Conservation Commission gave a Negative Determination on February 23, 2004.  After starting construction, the contractors encountered ledge, so Mr. Van Reed hired Greylock Design to design another driveway.  

After reviewing costs of both driveways, Mr. Van Reed decided to return to the original drive. Ms. Daignault submitted an amended narrative and plans.

All drainage will be controlled on site with a rip rap swale that follows along the upper portion of the driveway and culverts to alleviate and dissipate the drainage.  The water will be collected at the bottom and tie into the town drainage system and follow the rules and regulation of the Town of Lenox.  The driveway incline is at 15% with 10% at the top.  For now it will be a 12 foot wide gravel driveway.  With this plan there are 72 sf in the 100 foot buffer zone.  The other plan would have 5000 sf in the buffer zone.  NH has been contacted and told them they would have to file with MESA.  They said that a wildlife biologist would have to do a habitat assessment the site for the four toed and Jefferson salamander.  This will be done next week.
The plans for the house, pool and leaching fields will not change
Dick made a motion to continue to a later date until comments are received from Natural Heritage and Tim seconded the motion.  The Commission agreed 6-0.

8:00 p.m. Request for Determination of Applicability filed by Kathleen and Dennis Welch, property located at Main St. and Cliffwood St., Map 43 and portion of Parcel 69, to determine if property is subject to the Wetlands Protection Act.  (Continued from Jan. 18, 2007 as there was not a quorum.)  Applicant is under contract to purchase the property.  The Commission has been to the site and has determined there are no wetlands.

Joe made a motion to issue a Negative I and David seconded the motion.  The Board agreed 6-0.

Minutes:
        December 21, 2006  JS made a motion to approve and RFC seconded the motion.  The Commission approved 4-0. (DL and DF abstained as they were not present at that meeting.)
        January 4, 2007 DL made a motion to approve and RFC seconded the motion.  The Commission approved 4-0.  (TF and DF abstained as they were not present at that meeting.)

Toole Property, site of the new hotel, Toole Conservation Restriction.  Neal reported that there is no holder of the restriction yet.  Neal has been to the site, and would like to have rocks placed where the silt fence is now to keep people out and stop from mowing beyond rocks. Toole will d0 replication work on gravel driveway to be done the middle of August.

Carla Davis has inherited property that is the last house before the Aprea development on New Lenox Road.  She has contacted NC about rebuilding.  NC advised her that the property is within the 200 foot buffer zone, so she would need to file.  

Taylor Property on Undermountain Road:  The storm of November 29, 2006 downed about 2 acres of trees.  There are 6-8 trees down toward the road that are in the way of mowing that the Commission would like to have moved into the woods. DL will remove with a skidder.  RFC made a motion to remove the trees and DF seconded. The Commission agreed 6-0.  (At the Commission's request, the Town Manager will be notified.)

Lenox Country Shops:  Neal has been in touch with Scott of SK Design.  A split rail fence has been placed 20 feet from where it should be placed for snow removal, which the Commission did not want. Neal advised Scott that this is prohibited by the Commission and Scott has complied by putting in an orange silt fence.  When the ground thaws, the split rail fence will be moved.  NC made a comment that the developers have been responsive and cooperative.


RFC made a motion to adjourn and DF seconded the motion. The Commission approved 6-0.
