Minutes

Members present:  Acting Chair David Lane (DL), Rose Fitzgerald Casey (RFC), Tim Flanagan (TM), Joe Strauch (JS), Dick Ferren (DF)
Absent with notification:  Neal Carpenter
Also in attendance was Laura Saldarini

There was nothing on the Agenda for tonight’s meeting.

·       Minutes:  November 2, 2006.  RFC made a motion to approve the minutes and DF seconded.  The Commission approved 5-0.
·       Mail received was reviewed.
·       Hampton Inn, Joe Toole’s project:  TF had gone to the site and noticed that there was drainage going into wetlands under silt fencing.  No one was at the site at the time; members will meet and go to the site to inspect.
·       Lenox Gateway:  A letter and plans were submitted to the Conservation Commission regarding the recent changes that have been made.  Neal Carpenter reported to PA last week that he had spoken to Jim Scalise of SK Design, civil engineers for this project, told Neal that there would not be a change in the footprint.  JS and DF felt that it was difficult to determine from the plans submitted what the changes were and felt that it would be best to have the applicant come before the Commission to discuss.  TF felt that a new submission of project change should be required to allow for site review.  After some discussion it was decided to pass this information on to NC and follow up if NC agreed to pursue further.  
·       Patti and Jessie Spector:  Neal reported to PA that the Conservation Restriction on property recently given to the Town by the Spector’s was signed by the Conservation Commissioners on November 4, 2006
·       Hashim’s Property, on Pittsfield Road. TF and JS went to look at this property without the advantage of plans.  This was an informal request by Rob Akroyd and his consultant for the CC to look at this property for wetlands.  There was discrepancy regarding wetlands with the Commissioners and consultant and Rob Akroyd.   Following the site visit, the consultant called TF wanting feedback.  TF felt the consultant wanted to negotiate an approval for a line, but TF informed the consultant and Rob Akroyd that enough data was not submitted, and were advised to file appropriately.  PA was asked to research CC files for everything on the Hashim property also known as Brushwood Farms.
·       Merritt, Conservation Restriction:  The Commission decided to table this until NC is present.
·       Scenic Mountain Act:  PA advised that Melissa Jette of BRPC had made comments on the edits which had been reviewed earlier by the CC.  As a result of their review, changes were made.  The CC will now look at Ms. Jette’s comments.  Since it has been awhile since the CC has looked at the ACT after their changes, PA told the members she would email Ms. Jette’s comments, the


·       web address for the Town of Monterey where the Monterey Scenic Act is posted, and the up-to-date draft of our version.  Hard copy of all of that was given to DL for his review.  The Commission will then review all info available, including the items NC had highlighted.  Then incorporate all changes.  TF showed the map with up-to-date revisions.
·       Town Wetland Bylaw:  JS made a motion that the Commission look into a Town Wetland Bylaw and TF seconded the motion.  The Commission approved 5-0.
·       Cliff Van Reed:  Today the Conservation Commission received an RDA for this applicant submitted by Greylock Design.
·       Informal Requests:  The Commission wants to discuss this policy with NC when he returns.  This is taken advantage of by individuals who are professionals.
