7:30 p.m. Richard Chen, RDA,32 Holmeswood Terrace., Map 50 Parcel 32 to bring in fill material and grade rear yard
Shannon Boomsma and Jonathan Duda presented the RDA.  The Conservation Commission met on site with Shannon and Jonathan on August 9, 2006.  The applicant presented a revised site plan as a result of that visit.
There is a low area in the back of the home that the Chens want to re-grade and seed.  The area to be re-graded is 45 feet (north to south) by 50 feet (east to west).  The grading will be sloped to run toward wetlands and dugout area.  A fence is proposed at the easterly property line.  White spruce will be planted and the existing cypress will remain.  The dugout area will be re-seeded only; with no other plantings in that location.
Jonathan will call Neal when the silt fence is installed.
Rose made a motion to grant a Negative 3 determination with the revised plan.  Tim seconded the motion and the Commission agreed 5-0.  

Other business:
·       Minutes of August 3, 2006.  Rose made a motion to approve with correction of both Site Visit dates (from August 10 to August 9) and David seconded the motion.  The Commission approved 5-0.
·       Steven Allen, 28 Holmeswood Road, Map 50 Parcel 33.  The Commission discovered at the Site Visit to Richard Chen’s home that work in violation of the Wetland’s Protection Act was being done at this location.  Peggy will send a letter to Mr. Allen and ask him to appear before the Commission on September 7, 2006 at 8:30 p.m.
·       Kennedy Park, Baker Pond improvements, Map 22 Parcel 21.  Revised plans dated August 7, 2006 were received on August 14.  The Commission completed the Order of Conditions.
·       Michael Giles: Neal met at this property with Mr. Giles to discuss putting in a small dock.  Both Mr. Giles and Neal read the information referred to in the minutes of August 3, 2006, and decided that a small area where his children could walk to the water’s edge would suffice.  If at a later date Mr. Giles decides to put in a small dock, the process with the Conservation Commission would be to file an NOI.
·       Site Visit:  August 24, 2006, 6:00 p.m., Buccaneer Development, Abbreviated Notice of Resource Area Delineation, property at 12 East St., Map 4 Parcel 34, to review BVW delineation and Mean annual High Water Line.
8:30 p.m.  Robert Sitzer, NOI, 152 Plunkett St., Map 3 Lot 75, proposed garage addition and septic upgrade.  Mike Kulig of Berkshire Engineering and Mr. Sitzer presented this request.  A file number has not been received.  
1) The septic system is troublesome and below grade.  Plans were shown and discussed for the upgrade.  An existing curtain drain will remain.  The Commissioners felt that given the property, the upgrade was impressive.
Joe made a motion to continue the hearing until September 7, 2006 at 7:45 p.m. (expecting to have a file number at that time) and Tim seconded the motion.  The Commission agreed 5-0.
2) Proposed garage/barn/workshop:  The Commission told Mr. Kulig and Mr. Sitzer that the placement of this structure would be 10 feet from the brook and that this was not acceptable.  Discussion took place regarding alternative locations.

Rose made a motion to close the meeting and Joe seconded it.  The Commission agreed 5-0.  The next meeting is September 7, 2006 at 7:30 p.m.
