April 10, 2007

The meeting of the Hull Board of Selectmen was called to order at 7:37 pm on Tuesday evening, April 10, 2007 at the Hull Municipal Building, 253 Atlantic Avenue, Hull, Massachusetts
Present: John Reilly, Chairman; John Silva, Vice Chairman; Ron Davy, Clerk; Christopher Olivieri, and Joan Meschino, Members. Also present were Phillip Lemnios,, Town Manager, and James Lampke, Town Counsel.

The Chairman opened the meeting and welcomed Town Manager Phil Lemnios to his first meeting on his return to service for the Town of Hull.

7:30 pm – Public Hearing – Peter Booras dba West Corner Auto Wholesale, 52 Nantasket Avenue-Class II Wholesale Car dealers License

The Chairman swore in those who might wish to speak at the hearing. Peter Booras told the Board that as a wholesaler he was required to have a license to dispose of vehicles and needed just an office which is also required. No vehicles will be on the premises.

Moved-Silva: To approve with the proviso that no cars displayed, sold or repaired at the address that is to be an office only.

Vote: Unanimous in favor

CORRESPONDENCE

# 1 Unanimously approved the request of Charles & Rosemary Allen of 6 Driftway to host their daughters wedding using Driftway on Saturday, July 21st and 22nd; to erect a tent on Driftway from the 19th to the 24th on a motion by Silva, seconded by Olivieri.

# 2 – Held Letter from the Flemings re: railroad bed L to XYZ Streets

# 5 – Held letter from affordable Housing Committee re Compliance with Ch 40B

#7 - Held letter from Nancy Bilodeau re removing poses from railroad bed (See #2)

#3 - Authorized Town Manager to sign the Hull Yacht Club agreement, finalize and give to Board to sign, on a motion by Silva, seconded by Davy. AND unanimously approved amendment as drawn by Town Counsel, seconded by Olivieri

# 4 – Read aloud correspondence from Secretary of Defense in support of the Guard and Reserves

8:00 pm – Karen Medici – re: Highview Lodging House, Application for lodging house license

The Chairman opened the hearing and swore in the applicant and others wishing to speak. There were reports of several violations, which the inspectors testified have been addressed. The applicant had failed to renew the license at the proper time and thus the license expired..

Approximately 23 persons attended the hearing and had varied complaints about its operation.

Mike Cunningham, Hull’s Veterans Agent told the Board that the lodging house had many veterans and there are questions about the delivery of medications, handling of fund and that there are investigations in progress.

Town Counsel conducted the questioning. He stated that the last license was issued in 2004. In response to his question of visits from the VA, the response was “about 12 years ago.

Reilly told the applicants to update the application and that the hearing is continued for two weeks at 9:00 pm.

The meeting recessed at 9:04 pm and returned to open session at 9:26 pm.

8:30 pm – Public Hearing – Fred Means, 410 Nantasket Avenue-Class II Used Car Dealers License – New

The Chairman swore in the applicant and those present who wished to comment. Fred Means said he has taken over what was once Fred Rust’s who had a dealers license and that he is seeking 6 to 10 cars, Means said he will fulfill his warranty repairs at his other lot at 231 No. Quincy Street, in Abington, Mass.

Moved-Silva: To grant the Class II Auto Dealers License

LICENSES

Unanimously approved the All Alcoholic (Seasonal) as a general premises licensee to Sea Notes, Inc. dba The Sea Note, Joseph Phillips , Manager, 159 Nantasket Avenue on a motion by Olivieri, seconded by Meschino. AND

Unanimously approved the Entertainment (DJ & Live) and Automatic Amusement (Pool table & video games) on a motion by Olivieri, seconded by Meschino.

Unanimously approved a one day all alcoholic for Knights of Columbus, 410 Nantasket Avenue on April 30th from 7pm to 12 midnight and a one day all alcoholic for May 5, 2007 from 6pm to 11 pm on motions by Davy, seconded by Silva

The Board returned to correspondence #2 from the Flemings in regard to the railroad bed between L and XYZ Streets in regard to the poles that close off the road, having been removed. No one could identify why the poles were removed, but the agreement had been to close off the railroad bed closed May 2 – November 30th and re-opened December 1 to May to allow for plowing.

Town Manager Lemnios put forth the condition of the budget and provided a written copy of the revenues and expenditures. He said that it’s seriously out of balance and there is no easy solution and it represents a unique set of hurdles to overcome.
Davy announced he would be out of country for the next two weeks.

Meeting adjourned at 10:53 pm
