Minutes of Meeting— September 17, 2015
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, 2nd Floor, Town Hall, Hudson, Massachusetts.  At 7:00 PM, Todd Pietrasiak called the meeting to order.
Present:        Todd Pietrasiak, Dorothy Risser, Darja Nevits, Jason Mauro, Pamela Cooper, Teresa Vickery, Clerk and Jack Hunter, Director of Planning & Comm. Dev.

Petition 1060:  12 Wheeler Road, Cont. Variance Section 5.8.1.2 c

The Board is in receipt of a letter dated September 14, 2015 from David Eastridge requesting a continuance to the Board’s meeting of October 8, 2015.  

After some discussion amongst the Board members it was decided that they would not grant any more continuances until Mr. Eastridge appears before the Board.  

Todd Pietrasiak, seconded by Dorothy Risser, made a motion to grant the request for continuance until the Board’s meeting of October 8, 2015 with the stipulation that no more continuances will be granted without the applicant appearing before the Board.

Vote: 5-0-0, Unanimous

Petition 1067:  38 Avon Drive, Special Permit - Accessory Dwelling Unit
Present were:   James & Kathy Klotz, Applicants
                Jim Harrington, Builder

Todd Pietrasiak convened the Public Hearing.

Dottie Risser read the Right of Appeal.

The applicant is a seeking a Special Permit under section 5.2.6 of the Zoning By-Laws to construct an Accessory Dwelling Unit in an existing garage space in the SA-8 Single Family District.  Mr. Harrington stated that the proposed unit will be comprised of approximately 823 square feet of habitable space.  There is an existing curb cut off of York Drive which is currently used as a second driveway for the home.  Ms. Risser asked what the surface of the second driveway is currently.  Mr. Harrington said it is not currently paved however it will be as this is part of the plan.  

Ms. Risser asked what is on the second floor of the addition.  Mr. Harrington said there is no second floor being proposed the full height is due to a cathedral height ceiling.  

Ms. Nevits would like an additional finding included regarding the existing second driveway.  
There was no input from the public.

Todd Pietrasiak, seconded by Darja Nevits, made a motion to go into deliberative session.  

Vote: 5-0-0, Unanimous

The Board has no issues with the plan.  

Todd Pietrasiak, seconded by Dorothy Risser, moved to grant a Special Permit under section 5.2.6 based on the following findings:

  • The Petitioners has standing to bring the Petitions, and;
  • The subject property is located in the SA-8 District, and;
  • The use will not have an adverse effect on present and future dwellings in the vicinity, and;
  • the use will not create traffic hazards or volume greater than the capacity of the street effected, and;
  • The Petitioners has provided an affidavit stating intent to occupy one of the dwellings, and;
  • The additional driveway was existing with an existing curb cut.
Vote: 5-0-0, Unanimous

Todd Pietrasiak, seconded by Dorothy Risser, made a motion to come out of deliberative session.

Vote: 5-0-0, Unanimous
