Zoning Board of Appeals Minutes 11/13/14
Minutes of Meeting— November 13, 2014
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, 2nd Floor, Town Hall, Hudson, Massachusetts.  At 7:00 PM, Lawrence Norris called the meeting to order.
Present:        Lawrence Norris, Dorothy Risser, Christopher Tibbals, Todd Pietrasiak, Jill Schafer, Jennifer Burke, Planning Director and Teresa Vickery Clerk.


Petition 1056: 44 Marlboro Street, Accessory Dwelling Unit
Present were:   Michele & Julio Sousa, Applicants

Lawrence Norris convened the public hearing.

Dorothy Risser read the Right of Appeal.

The applicant is requesting a special permit under section 5.2.6.3 or the zoning by-laws to construct an Accessory Dwelling Unit (ADU) within an existing barn in the SA-8 Single Family District.  Ms. Sousa explained that when they purchased their home there was an existing barn on the property.  She noted that the barn is approximately 1,800 square feet.  The barn was build by the developer of the subdivision behind the house; it was used to store equipment.  

The applicant is proposing using half of the area of the barn to create some housing for family members.  They are hoping this will not only help their family members but also add value to their home.  Mr. Sousa will be doing the work.  

Mr. Pietrasiak asked for clarification as to where the entrance to the unit would be.  Mr. Sousa stated that it would be on the right side of the barn.  They are planning on keeping the style of the façade the same while adding some doors and windows.  The barn has existing electricity and water.  

Ms. Risser noted that the driveway allows for ample parking.  There is an affidavit in the record that the home will be owner occupied and the applicant is aware of this.

Lawrence Norris, seconded by Dorothy Risser, made a motion to go into deliberative session.

Vote: 5-0-0, Unanimous

The Board agreed that all conditions have been met and is a good use of the existing property.  

Lawrence Norris, seconded by Dorothy Risser, moved to grant a Special Permit – Accessory Dwelling Unit under Section 5.2.6.3 (1) to build an Accessory Dwelling Unit within an existing barn based on the following findings:

  • The Petitioner has standing to bring the Petition, and;
  • The subject property is located in the SA-8 Single Family District, and;
  • The use will not have an adverse effect on present and future dwellings in the vicinity, and
  • The use will not create traffic hazards or volume greater than the capacity of the streets effected, and;
  • The Petitioner has provided an affidavit stating intent to occupy on of the dwellings.
Vote: 5-0-0, Unanimous

Lawrence Norris, seconded by Todd Pietrasiak, made a motion to come out of deliberative session.

Vote: 5-0-0, Unanimous

Petition 1057: 10 Dewey Street, Accessory Dwelling Unit
Present were:   Kathleen & James Brooks, Applicants
        Patrick Falla, The Home Store

Lawrence Norris convened the public hearing.

Dottie Risser read the Right of Appeal.

The applicant is seeking to build an Accessory Dwelling Unit in the SB Single Family District.  Mr. Falla explained that the applicant is requesting the Board grant a special permit for an addition to the existing structure of approximately 800 square feet.

The existing home is a 24 X 36 square foot raised ranch.  The addition will be the same size as the existing home and there will be an 18 inch wall between the two homes to blend them together.  The entrance to the addition will be on the side of the addition.  The look of the home will be that of a split level raised ranch.

The plans the Board has in hand do not reflect this as the design has recently changed due to meeting with Jeff Wood.    

Mr. Norris asked about the parking plan.  Mr. Falla noted that there will be only one vehicle being added to the dwelling.  Mr. Norris stated that it is required that two additional spaces must be shown on the plan.

The Board unanimously agreed to continue the hearing as the information presented at the meeting did not meet the requirements of the by-law.  New plans will be delivered by December 2nd as per Mr. Falla.  
Lawrence Norris, seconded by Dorothy Risser, made a motion to continue the public hearing for 10 Dewey Street to December 11, 2014 at 7:00 PM.

Vote: 5-0-0, Unanimous

Minutes

Todd Pietrasiak, seconded by Christopher Tibbals, made a motion to accept the minutes of September 11, 2014 as corrected.

Vote: 3-0-0, Lawrence Norris and Dottie Risser not voting.

At 7:50 PM, Jill Schafer, seconded by Christopher Tibbals, moved to adjourn.
