Minutes of Meeting— July 23, 2014
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, 2nd Floor, Town Hall, Hudson, Massachusetts. At 7:00 PM, Dottie Risser called the meeting to order.
Present: Dottie Risser, Joe Peznola, Darja Nevits, Christopher Tibbals, Jill Schafer and Teresa Vickery Clerk.
Petition 1036 – Notice of Project Change
Present were: Paul Giannetti, Atty. at Law
James Ward, Atty. at Law
Robert Moss, Madison Place
Atty. Giannetti explained that One Cabot Road LLC has sold the property on Cabot Road to Robert Moss. He has a copy of the deed which on page two references an easement with Wal-Mart which was granted as part of the original approval and is also part of this sale as well. Atty. Giannetti submitted the deed as well as the easement for the record.

Mr. Moss is now the owner of the comprehensive permit and will be developing this property. Atty. Ward has drafted a proposed decision which indicates that this change is not a substantial change to the permit. A condition will be added to the decision that any approval is contingent upon approval from Mass Housing.
Atty. Giannetti stated for the record that no other changes are being proposed at this time.
Darja Nevits, seconded by Dorothy Risser, made a motion to go into deliberative session.
Vote: 5-0-0, Unanimous
The Board had no issues.
Dorothy Risser, seconded by Darja Nevits, made a motion to accept the change to the Comprehensive Permit from One Cabot Road LLC to Madison Place Hudson LLC as a minor modification with the following condition:
- Final approval is contingent upon approval from Mass Housing for the transfer of ownership.
Vote: 4-0-1, Mr. Peznola abstained.
Darja Nevits, seconded by Christopher Tibbals, made a motion to come out of deliberative session.
Vote: 5-0-0, Unanimous

At 7:25 PM, Darja Nevits, seconded by Christopher Tibbals, moved to adjourn.
Vote: 5-0-0, Unanimous
