Zoning Board of Appeals Minutes 09/12/13
Minutes of Meeting— September 12, 2013
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, 2nd Floor, Town Hall, Hudson, Massachusetts.  At 7:00 PM, Joseph Peznola called the meeting to order.
Present:        Lawrence Norris, Joseph Peznola, Jim Smith, Dorothy Risser, Darja Nevits, Christopher Tibbals and Teresa Vickery Clerk.

Petition 1042: 2 Essex Drive, ADU
Present was:    Keith Berube, Contractor        

Mr. Norris convened the public hearing.

Ms. Risser read the Right of Appeal.

The applicant is seeking a special permit under section 5.2.6 of the zoning by-laws to allow for the construction of an accessory dwelling unit in the SA-8 Single Family District.  

Mr. Berube, acting on behalf of the applicants, explained that the exterior of the dwelling will not change except for changing some of the windows and a door added for side access to the unit.  

The existing garage area will house a bedroom, bathroom and small kitchenette.  The current living room will be an area of common space which is approximately 12’ X 15’ a shared laundry area, mud room and closet are also part of the common space.
The dimension of the garage are 13’ X 24’.  The total square footage of the ADU is 576 square feet which is well within the 750 square foot maximum.  

Mr. Peznola wants a condition included in the decision in which the driveway widened to the street.  He requested this so the new apartment has two spaces that do not have to interact with the existing driveway.

James Smith, seconded by Lawrence Norris, made a motion to go into deliberative session.  

Vote: 5-0-0, Unanimous.  Christopher Tibbals not voting.

Lawrence Norris, seconded by Darja Nevits, moved to approve petition 1042 and allow the construction of an Accessory Dwelling Unit based on following findings:

  • The Petitioner has standing to bring the Petition, and;
  • The subject property is located in the SA-8 Single Family District, and;
  • The use will not have an adverse effect on present and future dwellings in the vicinity, and;
  • The use will not create traffic hazards or volume greater than the capacity of the streets effected, and ;
And with the following conditions:
  • The driveway will be widened to accommodate two spaces for the new apartment without interaction with vehicles from the main house.  The driveway widening will be for the entire length of the driveway to Essex Drive.  

Vote: 5-0-0, Unanimous.  Christopher Tibbals not voting.

Lawrence Norris, seconded by James Smith, made a motion to come out of deliberative session.

Vote: 5-0-0, Unanimous.  Christopher Tibbals not voting.

Joe Peznola, seconded by Darja Nevits, made a motion to accept the minutes of August 8, 2013, as written.

Vote: 6-0-0, Unanimous

Adjournment

At 7:20 PM, Darja Nevits, seconded by Joe Peznola, moved to adjourn.
