Minutes of Meeting— March 10, 2011
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts. At 7:30 p.m., Lawrence Norris called the meeting to order.
Present: Lawrence Norris, Joe Peznola, Darja Nevits, Dorothy Risser, Todd Pietrasiak, Christopher Tibbals, Patrick Manzo and Teresa Vickery, Clerk.
Petition 1018: 15 Dean Street, Accessory Dwelling Unit - Special Permit
Present was: Laurinda Resendes, Applicant
Donny Resendes
At its last meeting the Board requested that the applicant submit a survey plan. Mr. Resendes supplied the Board with a plot plan as well as sketches of the proposed ADU. The Board reviewed the plans. The Board was satisfied with the plans.
Lawrence Norris, seconded by Joe Peznola, made a motion to go into deliberative session.
Vote: 5- 0-0, Patrick Manzo and Dorothy Risser not voting.
Lawrence Norris, seconded by Darja Nevits, , moved to grant a Special Permit under 5.2.6 based on the following findings:
- The Petitioner has standing to bring the Petition, and;
- The subject property is located in the SB District, and;
- The use will not have an adverse effect on present and future dwellings in the vicinity, and;
- The use will not have create traffic hazards or volume greater than the capacity of the streets effected, and;
- The petitioner has provided an affidavit stating intent to occupy one of the dwellings.
And the following conditions:
- One of the dwelling units will be owner occupied as required by the zoning by-law.
Vote: 5-0-0, Patrick Manzo and Dorothy Risser not voting.
Joe Peznola, seconded by Darja Nevits, made a motion to come out of deliberative session.

Petition 1019 – 258 Washington Street, Special Permit
Present was: Paul Giannetti, Atty. at Law
Atty. Giannetti explained that the applicant has been before the Internal Traffic Committee as well as the Planning Board. The Planning Board granted the applicant conditional approval. The approval is contingent upon the conveyance 2 parcels of land to the Town, one a 15-foot strip and the other a one-square foot parcel, must be granted.
Atty. Giannetti explained that when The Richmond Companies (former owner of the land) could not find a tenant for the Starbucks and sold the property to Federated Construction LLC it seemed that this issue fell through the cracks. Attorneys for all involved are in the process of getting the deeds drawn up. At the time of the Planning Board meeting Atty. Giannetti did not think that this would take more than a couple of weeks. This has not proven to be the case.
Atty. Giannetti is hoping these issues will be resolved before the next meeting. He is requesting a continuance to the next meeting of April 14, 2011.
The Board requested that Atty. Giannetti submit a letter requesting the extension to convene the public hearing. He agreed to supply one to the Board
Joe Peznola, seconded by Dorothy Risser, made a motion to reschedule the meeting for April 14, 2011 at 7:30 PM.
