Minutes of Meeting— January 13, 2011
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts.  At 7:30 p.m., Dorothy Risser called the meeting to order.
Present:        Dorothy Risser, Darja Nevits, Todd Pietrasiak, Christopher Tibbals, Patrick Manzo, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Petition 1017:  1 Kane Industrial Drive, Special Permit
Present was:    Galen Miller, Applicant
                Malcolm Houck, Attorney
                Jim Kane, Property Owner

At its previous meeting the Board had continued the public hearing informing Atty. Houck that he first needed to seek site plan approval from the Planning Board before continuing on to the special permit granting phase of the approvals.  Therefore, the public hearing was continued.  

Atty. Houck stated that the applicant had been granted site plan approval from the Planning Board on January 3, 2011.  

Atty. Houck informed the Board that the applicant is proposing to open a shop for the sales and repair of motor sports vehicles in an existing 6,000 square foot concrete block building at the front of the Kane Industrial Park.  

The facility will include a state inspection station.  Hazardous materials generated on site will be in very small quantities.  Anti-freeze will be picked up by Cyn Environmental Services of Stoughton.  Tires will be recycled by Ruthier & Sons of Littleton and battery replacements will be removed by Framingham Salvage Co. of Framingham.  Metal scraps will also be removed from the premises.  

Ms. Risser asked what the square footage is for the retail space.  Mr. Miller stated it is approximately 9,000 – 15,000 square feet.  Ms. Risser noted that one parking space is required per every 200 square feet of retail space.  There are 12 existing parking spaces which is more than sufficient.  

Mr. Pietrasiak asked if the applicant intended on showcasing some of the vehicles outside.  Mr. Miller stated that some would however they would all be brought back into the building at night.  

Ms. Risser asked what is entailed in the inspection of a motorcycle.  Mr. Miller explained it is the same as an automobile inspection.  All inspections will be done inside the building.  

There will be no changes to the existing building with the exception of the signage at the front of the building.  

There was no input from the public.

Darja Nevits, seconded by Dorothy Risser, made a motion to go into deliberative session.

Vote: 5-0-0, Unanimous

Ms. Risser expressed her concerns regarding screening and floor drains.  Even though they will not be necessary for this applicant she feels it is necessary to condition these.  She noted that the special permit remains with the property and her concern is for any subsequent owners or tenants.  The Board agreed.

Dorothy Risser, seconded by Todd Pietrasiak, moved to grant a Special Permit under 3.3.10 based on the following findings:
          
The Petitioner has standing to bring the Petition, and;
The subject property is located in the M-6 Industrial District, and;
The use is in harmony with the purpose and intent of this by-law and will promote the purposes of the Watershed Protection District as outlined in the project plans, and;
The use is appropriate to the natural topography, soils and other characteristics of the site to be developed, and;
The use will not have an adverse environmental impact on any water body or course in the district or the existing water supply.

And with the following conditions:
  • All disabled vehicles must be screened from abutting lots or exterior streets by a solid landscaped screen and/or fence at least five (5) feet but no more that seven (7) feet in height, and;
  • Oil and grease traps must be installed in all floor drains, and;
  • 110% containment for all waste products and potential contaminants must be present on site.
Dorothy Risser, seconded by Todd Pietrasiak, moved to grant a Special Permit under 5.3.3.1 based on the following findings:

  • The Petitioner has standing to bring the Petition, and;
  • The subject property is located in the M-6 Industrial, and;
  • The use will not have an adverse effect on present and future dwellings in the vicinity, and;
  • The use will not have create traffic hazards or volume greater than the capacity of the streets effected.
And the following conditions:
  • All disabled vehicles must be screened from abutting lots or exterior streets by a solid landscaped screen and/or fence at least five (5) feet but no more that seven (7) feet in height, and;
  • Oil and grease traps must be installed in all floor drains, and;
  • 110% containment for all waste products and potential contaminants must be present on site.
Darja Nevits, seconded by Dorothy Risser, made a motion to come out of deliberative session.

Vote: 5-0-0, Unanimous
