Minutes of Meeting— February 10, 2011
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts.  At 7:30 p.m., Lawrence Norris called the meeting to order.
Present:        Lawrence Norris, Joe Peznola, Darja Nevits, Todd Pietrasiak, Christopher Tibbals, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Petition 1018:  15 Dean Street,  Accessory Dwelling Unit - Special Permit
Present was:    Laurinda Resendes, Applicant
                Donny Resendes

Mr. Norris convened the public hearing.

Ms. Nevits read the right of appeal.

Mr. Resendes spoke on behalf of his mother.  He stated that she is seeking a special permit under section 5.2.6 of the zoning by-laws to allow the construction of an Accessory Dwelling Unit in an SA-8 residential district.  He explained that since the death of his father he and his wife have been staying with Mrs. Resendes.  They have two children and are expecting a third.  Adding an ADU would allow them separate quarters still enabling them to be close.  

Mrs. Resendes has provided an affidavit stating that as the owner she will occupy one of the dwellings.  

The ADU will have a full bath and kitchen.  There will be two means of egress and six parking spaces.  The home will maintain the appearance of a single family structure.  The ADU will be over the garage.  No impact to traffic as Mr. Resendes and his family currently live in the home.    

Ms. Nevits stated that the only issue here seems to be that the plans need to be better.  The Board is requiring that the applicant provide a surveyed plan.  

Mr. Peznola asked if the home utilizes Town sewer.  Mr. Resendes said yes.  He then asked what will be on the lower level of the ADU.  Mr. Resendes stated that there will be a utility room and a playroom for the children at the back end.  Because the playroom is considered habitable space this will bring the total square footage to 1,061 square feet.  The ADU shall not exceed 25% of the habitable floor area of the entire dwelling or 900 square feet, whichever is greater.  

The Board will continue the hearing to its next meeting at which time the applicant will bring in proper surveyed plans.

Joe Peznola, seconded by Darja Nevits made a motion to continue the public hearing for 15 Dean Street until March 10, 2011 at 7:30 PM.

Vote: 5-0-0, Unanimous
