Minutes of Meeting— November 4, 2010
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts. At 7:30 p.m., Dorothy Risser called the meeting to order.
Present: Dorothy Risser, Darja Nevits, Todd Petrasiak, Christopher Tibbals, Patrick Manzo, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.
Petition 1017: 1 Kane Industrial Drive, Special Permit

Dorothy Risser convened the public hearing
Darja Nevits read the Right of Appeal.
The Applicant is seeking a special permit to allow for the storage and repair of motor vehicles within the Watershed Protection District in the M-6 Industrial District.
Ms. Risser stated that the Board of Health did not have any issues with the plan. She also stated that the Conservation Commission noted that there must be oil and grease traps in the floor with a 110% containment capacity.
Atty. Houck informed the Board that the existing building is 6,000 square feet in area and is located on lot 3 of 1 Kane Industrial Drive. The proposed space will be used for the storage and repair of motor vehicles.
The parking area is 10,000 square feet and is off street parking. Trash and tire removal will be arranged by the applicant. Fluids are recycled and picked up on a regular basis. The parts that need to be picked up will be on an on call basis.
Ms. Risser informed Atty. Houck that this special permit triggers site plan review under section 7.1.7.2 (d) and 3.3.10 (V) A. (1) of the zoning by-laws. At this point she explained his options to him. She stated that at this time the applicant could withdraw without prejudice and when he refiles the fee would be waived, he could choose to continue the hearing at which point the Board would deny the permit or he could ask for a continuance in writing.
Atty. Houck opted to request a continuance. He proceeded to write the continuance and present it to the Board. Now that the Board was in receipt of his request to continue dated November 4, 2010 they continued the hearing to it’s meeting of January 13, 2011.
Darja Nevits, seconded by James Smith, made a motion to continue the hearing for 1 Kane Industrial Drive until January 13, 2011 at 7:30 PM.
Vote: 6-0-0, Unanimous

James Smith, seconded by Dorothy Risser, made a motion to accept the minutes of August 12, 2010, as corrected.
Vote: 5-0-0, Darja Nevits abstaining.

At 8:00 PM, Christopher Tibbals, seconded by Todd Petrasiak, moved to adjourn.
