Minutes of Meeting— August 9, 2007
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts.  At 7:30 p.m., Chairman Lawrence Norris called the meeting to order.
Present:        Lawrence Norris, Joe Peznola, James Smith, Alan Herzog, Darja Nevits, Dorothy Risser, Christopher Tibbals and Jennifer Burke, Town Planner.
Petition 2007-01: Glendale Road Special Permit
Present was:            Christopher Yates, Atty. at Law

Atty Yates updated the Board.  They have received site plan approval.  The Board asked for copies of the signed plan.  They will provide the copies.  Atty. Yates asked for a continuation in order to provide the plan.  Ms. Risser also asked for proof of septic approval from the Board of Health.

Joe Peznola, seconded by Alan Herzog, made a motion to continue the public hearing for Petition 2007-01 until September 20, 2007 at 7:30 p.m.

Vote: 5-0-0, Unanimous
September Meeting

On a motion by Joe Peznola, seconded by James Smith, made a motion to reschedule the September 13th meeting to September 20th.

Vote: 7-0-0, Unanimous
Petition 2007-04 220 Manning Street, Special Permit
Present were:           Raymond Firth
                        
Lawrence Norris convened the public hearing.
Alan Herzog read the Right of Appeal.

Mr. Firth presented the petition to the Board.  There is an existing 18’ x 20’ garage.  It is located one foot off the side lot line.  The garage existed prior to zoning.  Mr. Firth would like to demolish the existing garage and remove the foundation.  They would like to rebuild and expand the garage to 21’ x 45’.

Mr. Peznola noted that the plan shows the existing setback at 3.9 feet and the proposed at 3.4 feet.  The applicant must maintain the 3.9 feet.  He asked what the use will be.  Mr. Firth stated that he will be using the garage to store his boat.

Mr. Norris asked if the new garage will be on a slab or foundation.  He was told a foundation would be used.  He also asked about utility services.  He was told no water or sewer services would run to the garage.

Ms. Nevits asked if the front door would be the only access.  She was told no.  There will be a side door and windows.

It was noted that there would be no increase of traffic as the boats is stored on site already.

There was no imput from the public.

Lawrence Norris, seconded by James Smith, made a motion to go into deliberative session.  

Vote: 5-0-0, Unanimous

Lawrence Norris, seconded by James Smith, moved to approve Petition 2007-04 and to grant a Special Permit under Section 5.1.6.2, to allow for the demolition of the existing garage and the reconstruction/expansion of a new garage as shown on the plan entitled “Proposed Garage Addition 220 Manning Street Hudson, MA” as drawn by Zanca Land Surveying, Stow, MA dated June 5, 2007, based on the following findings:

The Petitioner has standing to bring the Petition, and;

The subject property is located in the SA-8 Single Family District, and;

The use will not have an adverse effect on present and future dwellings in the vicinity, and;

The use will not create traffic hazards or volume greater than the capacity of the streets effected, and;

The garage was in existence at the time of adoption of the by-law, and;

And with the following conditions:

The building is to be constructed such that the minimum distance to the side lot line will be 3.9 feet and the minimum distance to the rear lot line will be 3 feet.

The only utility service to the garage will be electricity.

There will be one other means to egress to the garage other than the front door.

Vote: 5-0-0, Unanimous (Dorothy Risser and Christopher Tibbals not voting)

On a motion by Alan Herzog, seconded by Darja Nevits, made a motion to approve the minutes of June 14, 2007.

Vote: 5-0-0, Unanimous
