Minutes of Meeting— May 10, 2007
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts.  At 7:30 p.m., Chairman Lawrence Norris called the meeting to order.
Present:        Lawrence Norris, Joe Peznola, James Smith, Alan Herzog, Dorothy Risser, Darja Nevits, Sara Lafluer, Christopher Tibbals and Teresa Vickery, Clerk.
Petition 2007-01: Glendale Road Special Permit

The Board is in receipt of a letter from Atty. Yates asking for a continuation.

Joe Peznola, seconded by Darja Nevits, made a motion to continue the public hearing for Petition 2007-01 until June 14, 2007 at 7:30 p.m.

Vote: 5-0-0, Unanimous
Petition 2007-02 Lamson Avenue, Special Permit
Present were:           Paul Gianetti, Atty. at Law
                        Elizabeth Mary Conley, Property Owner

Lawrence Norris convened the public hearing.
Alan Herzog read the Right of Appeal.

Ms. Conley is seeking a Special Permit under Section 5.2.3.1 (i) of the Zoning By-Laws to allow for the conversion of a single family dwelling to a two family dwelling in an SB Single Family District.  

Lawrence Norris read into the record a letter from Mr. & Mrs. Charles Anastas of 10 Lamson Ave. in support of converting the home to a two family.    

Atty. Gianetti informed the Board that the house was built in 1920 before the Zoning By-Laws were adopted in 1957.  The home was built as a two family structure, however for the past two years has been a one family home.  Because of this it has lost its grandfather status.  

The home will be owner occupied and utilizes town water and sewer.  The Petitioner is proposing side by side apartments not a first and second floor two family structure.  Both Unit A and Unit B have two egresses.  Currently there is a three-car garage that exits out on to Cox Street.  The plans show that a second driveway will be constructed exiting onto Lamson Ave that will also accommodate three vehicles.  

Mr. Peznola asked if there was interior access to the basement.  Atty. Gianetti stated that each unit has its own access.  

There was no imput from the public.

James Smith, seconded by Dorothy Risser, made a motion to go into deliberative session.  

Vote: 5-0-0, Unanimous

Lawrence Norris, seconded by Darja Nevtis, moved to approve Petition 2007-02 and to grant a Special Permit under Section 5.2.3.1 (i), to allow for the conversion of the existing single family dwelling into a two family dwelling as shown on the plans by Consolidated Design Group, Hudson, MA dated April 23, 2007, based on the following findings:

The Petitioner has standing to bring the Petition, and;

The use will not have an adverse effect on present and future dwellings in the vicinity, and;

The use will not create traffic hazards or volume greater than the capacity of the streets effected, and;

The use is in harmony with the purpose and intent of the by-law.

And with the following condition:

The dwelling must be owner occupied.

Vote: 5-0-0, Unanimous

James Smith, seconded by Dorothy Risser, made a motion to come out of deliberative session.

On a motion by Lawrence Norris, seconded by James Smith, made a motion to approve the minutes of April 12, 2007as corrected.

Vote: 5-0-0, Unanimous
