Minutes of Meeting— July 28, 2005
The Hudson Board of Appeals met in the Selectmen’s Hearing Room, Town Hall, Hudson, Massachusetts.  At 7:30 p.m., Chairman Lawrence Norris called the meeting to order.
Present:        Lawrence Norris, Alan Herzog, Darja Nevits and Dorothy Risser
                Jennifer Burke, Town Planner

Petition 2005-06:     14 Belleview Street
Present:        William Knapp & Lauren Dandreta

Mr. Knapp presented the detailed plans to the Board.  The Board questioned the lack of a first floor bathroom.  Mr. Knapp explained that eventually they will put one in the first floor but in the meantime, they were planning to use the bathroom in the basement.  Ms. Risser expressed concern that the bathroom in the basement is on a failed Title 5 system.  She noted that the P & S requires abandonment of the system.  The Board will require that action prior to issuance of a Certificate of Occupancy.

The Board asked about the second egress on the second floor.  Mr. Knapp indicated that the window next to the fire escape would become a door.

Finally, the Board noted that eight parking spaces have been provided.  The applicant is proposing to pave between the two existing drives.
Darja Nevits, seconded by Dorothy Risser, moved to enter deliberative session.

Vote: 4-0-0, Unanimous

Lawrence Norris, seconded by Darja Nevits, moved to approve Petition 2005-06 and to grant a Special Permit under Section 5.1.6.1, to allow for the expansion of a pre-existing non-conforming use by changing a two family dwelling into a three family dwelling as shown on the Proposed Floor Plans as drawn by David Gerber Associates dated July 28, 2005 and the Site Plan of Land in Hudson, Mass. As drawn by Thomas Land Surveyors and dated July 28, 2005, based on the following findings:

The Petitioner has standing to bring the Petition, and;

The subject property is located in the SB Single Family District, and;

The use will not have an adverse effect on present and future dwellings in the vicinity in that many of the surrounding building are already multiple family dwellings, and;

The use will not create traffic hazards or volume greater than the capacity of the streets effected, and;

The applicant has provided suitable parking for three dwelling units, and;

The dwelling will maintain the character of a single family  dwelling, and;

And with the following conditions:

Prior to the issuance of a Certificate of Occupancy, a bathroom will be installed on the first floor.

Prior to the issuance of a Certificate of Occupancy, the existing Title 5 system will be abandoned.

Prior to the issuance of a Certificate of Occupancy, the parking area as shown on the plan from Thomas Land Surveyors dated July 28, 2005 will be paved.

One of the dwellings will be owner occupied.
