Minutes  – August 28, 2017

  • Call to Order:
Present were Mr. Duplisea, Mr. Parent, Mr. Quinn, Mr. Lucy, Mr. Durant and Mr. Moses.  Also present were Attorney Cipriano and Ms. Vickery.
  • Minutes to be Approved:
Public Session Minutes – August 14, 2017
On a motion by Mr. Duplisea, seconded by Mr. Lucy, the Board voted 5-o to approve the public session minutes of August 14, 2017.
  • Meetings and Public Hearings - 7:00 PM:
Selectmen to conduct hearing on an application to erect a new utility pole on Brigham Street. To be continued to September 11, 2017 at 7:00PM

  • Licenses:
Selectmen to consider approval of an Entertainment License to the Hudson Business Association for the Annual Downtown Stroll to be held on December 2, 2017 from 4:00 PM – 8:00 PM.
On a motion by Mr. Lucy, seconded by Mr. Duplisea, the Board voted 5-0 to issue an Entertainment License to the Hudson Business Association for the Annual Downtown Stroll to be held on December 2, 2017 from 2:00 PM – 8:00 PM.
Selectmen to consider approval of an application for a Change of Beneficial Interest of an All Alcohol Pouring License received from 99 West, LLC d/b/a 99 Restaurant & Pub at 255 Washington Street.
On a motion by Mr. Lucy, seconded by Mr. Durant, the Board voted 5-0 to approve an application for a Change of Beneficial Interest of an All Alcohol Pouring License received from 99 West, LLC d/b/a 99 Restaurant & Pub at 255 Washington Street.
Selectmen to consider approval of a Common Victualler’s License for P.R. Restaurants LLC d/b/a Panera Bread to be located at 2 Highland Commons East.  
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 4-0-1 to approve a Common Victualler’s License for P.R. Restaurants LLC d/b/a Panera Bread to be located at 2 Highland Commons East.  Mr. Durant abstained.  
  • Personnel:
Selectmen to note the retirement of Firefighter Michael Barry, effective August 13, 2017.
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to note the retirement of Firefighter Michael Barry, effective August 13, 2017.
Selectmen to consider approval of the appointments of Shawn Tessier and Alden Araujo as W-2 Laborers for the DPW at a Step 1, effective August 29, 2017.
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to approve the appointments of Shawn Tessier and Alden Araujo as W-2 Laborers for the DPW at a Step 1, effective August 29, 2017.
Selectmen to note the resignation of Marie Daigneault from the Hudson Police Department as a part-time Crossing Guard.  
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to note the resignation of Marie Daigneault from the Hudson Police Department as a part-time Crossing Guard.  
Selectmen to consider appointing Kristina Johnson to be the Minuteman Advisory Group on Interlocal Coordination (MAGIC) Representative.  
On a motion by Mr. Lucy, seconded by Mr. Duplisea, the Board voted 5-0 to appoint Kristina Johnson to be the Minuteman Advisory Group on Interlocal Coordination (MAGIC) Representative.  
Selectmen to consider appointing Jack Hunter to the following for terms to expire on August 26, 2019:
  • Minuteman Advisory Group on Interlocal Coordination Representative (MAGIC)
  • Assabet River Rail Trail Coordinator (ARRT)
  • Metrowest Regional Transit Authority Representative (MWRTA)
On a motion by Mr. Lucy, seconded by Mr. Duplisea, the Board voted 5-0 to appoint Jack Hunter as MAGIC, ARRT and MWRTA Representative.  
  • Contracts:
  • General:
Selectmen to discuss the disposition of the site at 62 Packard Street to make it available for Veteran’s Housing, Affordable Housing or Unrestricted Housing.  
Mr. Moses explained that if the Board wants to go the affordable housing route it would be much easier to transfer ownership to the Hudson Housing Authority (HHA).  Because they are a quasi-governmental agency the project would not need to go out to bid.  It was suggested that veteran housing be built on this parcel.  However veterans housing would not show preference to Hudson residents.  If the HHA made this affordable housing there is preference shown to Hudson Veterans.  
Mr. Duplisea suggested holding a public hearing to get input from neighbors/abutters.  He noted that if the property were transferred to the HHA they would have authority over the site not a state of private agency.  The Board of Directors of the HHA are all Hudson residents.  He is in favor of transferring it to the HHA.
Mr. Quinn and Mr. Lucy stated they are also in favor of transferring the property to the HHA.  
Glenn Davis, HHA Chairman explained that a lot of the financing would come through grants.
Mr. Durant suggested that a title search be done to determine what can be built there or what an appropriate use for the site is.  Atty. Cipriano stated that original source of title would need to be verified as well as its establishment as a school to ensure it was properly transferred from the school committee to the Town.  
Mr. Durant agrees this is a good use for the site but he thinks the Board should have a plan in place before deciding to transfer the building over to another entity.  He also feels it is important to give all neighbors and abutters the opportunity to weigh in on this.  Mr. Lucy recommended that an ad hoc committee be formed and that it include several neighbors.  
Marianne Neuman, 27 Packard Street and Jeff Supernor, 18 Plant Ave were both in attendance and both stated that they would like to be on the Committee.  
Mr. Moses will work on forming a committee and Atty. Cipriano will look into the title.  The Board took no action and will discuss this again in an upcoming meeting.
Discussion of recreational marijuana sales in Hudson.  
Mr. Parent stated that the Town has the option to impose a moratorium effective from November to May 2018 or May to November. The Town could also exclude it however if the Town voted in favor of medical marijuana (which it did) then the exclusion would have to be voted on by the Town.   He noted that zoning needs to be addressed with regard to this issue.  He asked the Board if they want to take a position or some action.
Mr. Lucy stated that he is in favor of the recreational sale of marijuana in Town, as he was for the medical sale and that is for the revenue.  He does agree that the zoning needs to be looked at.  
Mr. Parent suggested having some open public meetings to allow residents to voice their opinions regarding this issue.  Mr. Moses noted that he would not be inclined to draw conclusions from what people may say in a public forum regarding this subject.  Atty. Cipriano stated that the Planning Board, by law, will hold public hearings on this.  
Ann Marie Lourens, 4 Meadowbrook Road spoke out against allowing both medicinal and recreational marijuana in Town and cautioned the Selectmen to inform themselves before making a decision.  
Anthony Perinello, Temescul Wellness, CEO explained some of the regulations that are placed on medicinal marijuana and that will be placed on recreational as well.
Mr. Quinn asked what the voting results were.  Mr. Moses stated that the results were 53 % to 47 % in favor of recreational marijuana.  
The Board took no action.
