Minutes –June 6, 2016

  • Call to Order:
Present were Mr. Duplisea, Mr. Parent, Mr. Quinn, Mr. Lucy, Mr. Durant, and Mr. Moses.  Also present were Attorney Cipriano and Ms. Santos
  • Minutes to be Approved:
Public Session:  May 16, 2016
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve public session minutes of May 16, 2016.
  • Citizens’ Issues:
  • Meetings and Public Hearings - 7:00 PM:
Selectmen to meet with representatives from Melanson Heath to discuss Financial Statements Reports for fiscal 2015.
Frank Biron, Melanson Heath President and Zachary Fentross, Auditor presented the Town’s 2015 financial statements, management letter and auditors report.  Mr. Biron noted that the financial statements are in accordance with generally accepted accounting principles which he stated is the best opinion one can receive from an outside audit.  Mr. Biron briefly explained more specifics of the reports.  He summarized the statements by saying that the Town had a good year and bond rating agencies would look favorably upon these financial statements.  
  • Licenses:
Selectmen to consider granting One-Day Entertainment and Transient Vendor licenses to the Assabet Valley Chamber of Commerce for its 29th Annual Community Festival to be held on June 11, 2016 from 9:00AM-3:30PM.(scott said 3PM)
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve the One-Day Entertainment and Transient Vendor licenses to the Assabet Valley Chamber of Commerce for its 29th Annual Community Festival to be held on June 11, 2016 from 9:00AM-3:30PM.
Selectmen to consider granting a One-Day Wine & Malt Liquor License and an Entertainment License to Justin Provencher / Hudson Rotary Club for the Spirit of Hudson event to be held on August 13, 2016 from 3:00 PM to 7:00 PM at the Avidia Bank parking lot on South Street.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve the One-Day Wine & Malt Liquor License and an Entertainment License to Justin Provencher / Hudson Rotary Club for the Spirit of Hudson event to be held on August 13, 2016 from 3:00 PM to 7:00 PM at the Avidia Bank parking lot on South Street.
  • Personnel:
Selectmen to consider approval of appointments of Seasonal Employees for the Recreation Department for 2016.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 4-0-1, to approve the appointments of the Seasonal Employees for the Recreation Department for 2016.  Mr. Durant abstained.
Selectmen to consider appointing Alex Sanford as Summer Intern to the Hudson Veterans Office, effective June 7, 2016.
On a motion by Mr. Quinn, seconded by Mr. Lucy, the Board voted 5-0 to approve appointment of Alex Sanford as Summer Intern to the Hudson Veterans Office, effective June 7, 2016.
Selectmen to consider approval and authorization to sign an Employment Contract with Deborah A. Backman as Library Director.
On a motion by Mr. Lucy, seconded by Mr. Durant, the Board voted 5-0 to approve and authorize signing an Employment Contract with Deborah A. Backman as Library Director.
Selectmen to consider approval of appointment of Melissa Galvin as Accounting Advisor for the Hudson Board of Health at M3, Step 1.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve the appointment of Melissa Galvin as Accounting Advisor for the Hudson Board of Health at M3, Step 1.
Selectmen to consider approval of appointment of Susan Carey and Kristen Woodbury to the Hudson Affordable Housing Trust, to a term to expire on 12/31/2017.
On a motion by Mr. Durant, seconded by Mr. Lucy, the Board voted 5-0 to approve the appointments of Susan Carey and Kristen Woodbury to the Hudson Affordable Housing Trust, to a term to expire on 12/31/2017.
  • Contracts:
Selectmen to consider award of Centennial Beach and Wood Park Concession rights to Juniper Farms at 48.0% of gross sales for 2016.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to award the Centennial Beach and Wood Park Concession rights to Juniper Farms at 48.0% of gross sales for 2016.
Selectmen to consider award and authorization to sign a contracts with E.H. Perkins Construction Inc. and Brox Industries Inc. for Bituminous Concrete for FY2017.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to award and authorize signing a contract with E.H. Perkins Construction Inc. and Brox Industries Inc. for Bituminous Concrete for FY2017.
Selectmen to consider amending the contract with Blue Bumble in an amount not to exceed $9,999 for banners for the 150th Celebration.
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to approve the amendment of the contract with Blue Bumble in an amount not to exceed $9,999 for banners for the 150th Celebration.
Selectmen to consider award and authorization to sign a contract with Green International in the amount of $48,511.73 to conduct Tier 2 Scope of Work for the Complete Streets project.
Note:  Funded by MassDOT grant for Complete Streets.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to award and authorize signing the contract with Green International in the amount of $48,511.73 to conduct Tier 2 Scope of Work for the Complete Streets project.
Selectmen to consider award and authorization to sign a contract with New England Waste Service of ME, Inc. d/b/a Casella Organics for Sludge Transportation and Disposal.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to award and authorize signing the contract with New England Waste Service of ME, Inc. d/b/a Casella Organics for Sludge Transportation and Disposal.
  • General:
Selectmen to consider approval of HUD-TV FY2017 Budget in the amount of $223,682.
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to approve the HUD-TV FY2017 Budget in the amount of $223,682.
Selectmen to consider approval of FY2017 Salary Scale for Seasonal Employees for the Recreation Department, effective June 7, 2016.
Note:  Updated seasonal salary scale reflects the upcoming minimum wage increase from $10.00 to $11:00/hr.
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve the FY2017 Salary Scale for Seasonal Employees for the Recreation Department, effective June 7, 2016.
Selectmen to consider approval and award of bonds and execution of documents.
Mr. Lucy noted that the winning bidder is Merrily Lynch/Bank of America, he is disclosing that he works for Bank of America, however his financial interest is not substantial to affect the integrity of the service expected.  
On a motion by Mr. Lucy, seconded by Mr. Quinn, the Board voted 5-0 to approve and award of the bonds to execute documents.
Selectmen to consider issuance of a warrant, pursuant to MGL Chapter 140 § 151A of the MGL to capture, confine and, if necessary, euthanize unlicensed dogs in the Town.
Note:  This is an annual requirement to allow the Animal Control Officer to carryout the duties pursuant to Chapter 140 Section 151A.
Mr. Lucy asked that the motion be changed and the language that if a dog is to be euthanized it come before the Board before it is carried out.  Mr. Moses cautioned him as this could be an issue of public safety and cited an example.  Mr. Duplisea noted that this is pursuant to Mass General Law.  Mr. Lucy stated he would vote in favor however still recommends that if possible any proposed euthanizing come before the Board.  The motion remained in its original form.  
On a motion by Mr. Lucy, seconded by Mr. Parent, the Board voted 5-0 to approve and issue a warrant, pursuant to MGL Chapter 140 § 151A of the MGL to capture, confine and, if necessary, euthanize unlicensed dogs in the Town.

  • Town Issues:
Mr. Lucy noted that Christine Summer, an artist, has created a community mural along with twelve Hudson students as part of the Sesquicentennial celebration.  The mural will be unveiled on Saturday June 11, 2016 at 10:00 AM.  
Mr. Lucy stated that earlier this year in executive session Town Counsel shared a list of the top most delinquent taxpayers in Town; they are all estates.  He is requesting that the Board take this matter up again in executive session either at its next meeting or in July.  
Mr. Quinn is requesting that the Internal Traffic Committee revisit the intersection of Washington and Park Streets.  
Mr. Quinn noted that Richard Gelpke will be giving another talk on the downtown area and its history Tuesday, June 7, 2016 at 7:00 PM at the Senior Center
Mr. Duplisea thanked Brad Avery for the article that he wrote recently about Hudson’s downtown revival.  Mr. Durant echoed his sentiments and mentioned the piece on Chronicle about Hudson that aired last month.  All of this has helped to promote growth in the downtown.
Mr. Durant congratulated all of the HHS Class of 2016 graduates
  • Correspondence to be Noted by Clerk:
On a motion by Mr. Quinn, seconded by Mr. Lucy, the Board voted 5-0 to note correspondence.
  • Executive Session:
Selectmen to meet in Executive Session to discuss strategy with respect to potential challenge to the Massachusetts Energy Facilities Siting Board (MAEFSB) decision on the Eversource Petition, and or seek advice of counsel, where an open meeting may have detrimental effect on the legal position of the public body and the chair so declares.
The Board voted by Roll Call 4-1 to meet in Executive Session to discuss strategy with respect to potential challenge to the Massachusetts Energy Facilities Siting Board (MAEFSB) decision on the Eversource Petition, and or seek advice of counsel, where an open meeting may have detrimental effect on the legal position of the public body and the chair so declares, not to return to public session.  Mr. Durant opposed.
