Town of Hudson - Board of Selectmen
Minutes –June 1, 2015
78 Main Street  2nd  Floor  7:00 PM


  • Call to Order:
Present were Mr. Lucy, Mr. Durant, Mr. Duplisea, Mr. Parent, and Mr. Moses.  Also present were Attorney Cipriano and Ms. Santos.
  • Minutes to be Approved:
Public Session:  May 18, 2014
On a motion by Mr. Parent, seconded by Mr. Durant, the Board voted 4-0 to approve the minutes.
  • Citizens’ Issues:
Lee Murphy, 416 Main Street approached the Board and Mr. Lucy explained to him that the Board will be taking up his issue under Town Issues.  He then asked that Town Issues be taken out of order.  The Board agreed.
  • Personnel:
                Note:  The Dispatcher appointments are necessary to fill vacancies.  The                                Seasonal employees appointments are to staff summer programs in the                        respective departments
Selectmen to consider approval of appointment of Thomas Neufell as a Full-Time Communication Dispatcher at Grade 10, Step 1, effective June 4, 2015.
On a motion by Mr. Durant, seconded by Mr. Parent, the Board voted 4-0 to approve the appointment of Thomas Neufell as Full-Time Communication Dispatcher at Grade 10, Step 1, effective June 4, 2015.

Selectmen to consider approval of appointment of Nicholina Gioiosa as Part-Time Communication Dispatcher at NU-E, Step 1, effective June 4, 2015.
On a motion by Mr. Duplisea, seconded by Mr. Durant, the Board voted 4-0 to approve the appointment of Nicholina Gioiosa as Part-Time Communication Dispatcher at NU-E, Step 1, effective June 4, 2015.

Selectmen to consider approval of appointments of 2015 Seasonal Employees for the Department of Public Works.
On a motion by Mr. Durant, seconded by Mr. Duplisea, the Board voted 4-0 to approve the appointment of the 2015 Seasonal Employees for the Department of Public Works.

Selectmen to consider approval of appointment of 2015 Seasonal Employees for the Recreation Department.
On a motion by Mr. Parent, seconded by Mr. Lucy, the Board voted 2-0-2 to approve the appointment of the 2015 Seasonal Employees for the Recreation Department.  Mr. Durant and Mr. Duplisea abstained.

  • Contracts:
Selectmen to consider award of Centennial Beach and Wood Park Concession rights to Juniper Farms at 49.0% of gross sales for 2015.
                Note:  This contract was put out to bid and Juniper Farms was low-bidder.                       Juniper Farms is also a past contractor.
On a motion by Mr. Durant, seconded by Mr. Duplisea, the Board voted 4-0 to approve the contract for Centennial Beach and Wood Park Concession rights to Juniper Farms at 49.0% of gross sales for 2015.

Selectmen to accept and authorize signing a contract with Mass Department of Health in the amount of $100,000 for Substance Abuse Prevention Collaborative services.
                Note:  This contract is for a grant that the Health Department received.
On a motion by Mr. Durant, seconded by Mr. Parent, the Board voted 4-0 to accept and authorize signing a contract with Mass Department of Health in the amount of $100,000 for Substance Abuse Prevention Collaborative services.

Selectmen to consider approval and authorization to sign a contract with Lazaro Paving Corp. in the amount $308,885.10 for the Reconstruction & Reclamation of Vernon Drive, and a portion of Parmenter Road .
                Note:  This project is funded with tax revenue and was put out to bid, a total of               four bids were received.  Lazaro Paving was the low-bidder.
On a motion by Mr. Durant, seconded by Mr. Parent, the Board voted 4-0 to approve and authorize signing a contract with Lazaro Paving Corp. in the amount $308,885.10 for the Reconstruction & Reclamation of Vernon Drive, and a portion of Parmenter Road.

  • General:
Selectmen to consider issuance of a warrant, pursuant to MGL Chapter 140 § 151A of the MGL to capture, confine and, if necessary, euthanize unlicensed dogs in the Town.
                Note:  This is an annual requirement to allow the Animal Control Officer to                     carryout the duties pursuant to Chapter 140 Section 151A.  
On a motion by Mr. Parent, seconded by Mr. Durant, the Board voted 4-0 to issue a warrant, pursuant to MGL Chapter 140 § 151A of the MGL to capture, confine and, if necessary, euthanize unlicensed dogs in the Town.

Selectmen to consider allowing a temporary change of location of the Hudson-Concord Lodge Bingo license to the Portuguese Club starting on June 18, 2015 through the end of September 2015.  
                Note:  The Change of location is to accommodate renovations at the Hudson-                      Concord Elks.
On a motion by Mr. Duplisea, seconded by Mr. Parent, the Board voted 3-0-1 to grant temporary change of location of the Hudson-Concord Elks Lodge Bingo license to the Portuguese Club starting on June 18, 2015 through the end of September 2015.  Mr. Durant abstained.

Selectmen to consider acceptance of a $5,000 donation from Benderson Development for a marketing program to promote all restaurants in Hudson.
                Note:  This donation is in consideration of the Town’s efforts to obtain                                additional liquor licenses, and will be used to promote downtown restaurants.
On a motion by Mr. Parent, seconded by Mr. Durant, the Board voted 4-0 to accept the $5,000 donation from Benderson Development for a marketing program to promote all restaurants in Hudson.

Selectmen to consider approval and execution of documents for the sale of $1,595,978 in Bond Anticipation Notes.
On a motion by Mr. Durant, seconded by Mr. Parent, the Board voted 4-0 to approve and execute all documents for the sale of $1,595,978 in Bond Anticipation Notes related to Quinn Middle School..

Selectmen to consider approval at a subsequent Selectman meeting to amend the Personnel Regulations by adding Municipal Vehicle & Equipment Policy.
The Board will discuss this item at their meeting of 6/15/2015.
  • Town Issues:
1)   Mr. Lucy explained that the issue at hand is in regards to operating without a license/permit or operating in a manner that could potentially endanger the environment.  Mr. Lucy believes that the best course of action for a citizen to take if they have a complaint would be to call the Police if they see any infractions occurring.  Mr. Moses stated that perhaps calling the Executive Assistant’s office would be a better alternative as the office could determine what or if there is an infraction and then decide on an appropriate response.  
 Atty. Cipriano explained that the Town does its own regulatory enforcement.  He did note that the best resource for investigation and quick response is the Police Department.  They can then stop the activity at the time and send the information over to the appropriate enforcement officer.  Mr. Lucy agrees that an appropriate Town official should be present to witness such an event in order to take it to the next level.  
  David Daigneault, 6 Vernon Drive asked about the regulations regarding unregistered vehicles.  Chief Stephens noted that only one unregistered vehicle is permitted per property provided they are shielded from street view.  He then suggested that the Conservation Commission could investigate whether there is an excess of oils and improper fluids as it is in a floodplain and perhaps address it.  Mr. Lucy again stated that if an authorized Town employee witnesses this it can then be investigated.  
  • Mr. Parent stated that the additional notes that were included on the agenda are a great idea and he believes this helps people to decipher the items more easily.  
  •  Mr. Durant thanked Brian Stearns, Veterans Agent for the Memorial Day Parade as well as the dedication of the Houghton Street Bridge.  He also commended the personnel at the High School and members of the School Committee for the graduation ceremony.  He thanked all of the local organizations that sponsored scholarships to the graduates.  Mr. Duplisea echoed his sentiments.
  • Mr. Lucy noted an article in the latest issue of the Beacon (May 2015)”School Finance Board prepares a report of minimum local contribution”.  The article was all about School Department spending in each city and town.  In the article the DOE as well as state legislators recognize that the minimum local contribution per student is too low.    
  • Correspondence to be Noted by Clerk:
On a motion by Mr. Durant, seconded by Mr. Duplisea, the Board voted 4-0 to note correspondence.
  • Executive Session:
Selectmen to meet in Executive Session to discuss strategy with respect to I.A.F.F. collective bargaining, and or seek advice of counsel, where an open meeting may have detrimental effect on the bargaining position of the public body and the chair so declares.
The Board voted 4-0, by roll call, to adjourn and enter into executive session, not to return to public session, to discuss I.A.F.F. collective bargaining and to seek advice of counsel, if the Chair declares that an open session may have a detrimental effect on the negotiating position of the public body.
