Minutes of Meeting – February 2, 2016

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 PM, Bob D’Amelio called the meeting to order.

Present:        Rodney Frias, Dirk Underwood, Tom Collins, David Daigneault and Jack Hunter, Director.

304 Cox Street, Site Plan Review
The Board is in receipt of an email dated January 27, 2016 from the applicant requesting a continuance to the Board’s meeting of March 15, 2016.  

David Daigneault, seconded by Tom Collins, made a motion to continue the public hearing for 304 Cox Street until March 15, 2016 at 7:00 PM.

Vote: 4-0-0, Unanimous.

571A Main Street, Site Plan Review
Present was:    Tom DiPersio, Thomas DiPersio, Jr. & Associates

Mr. Frias convened the Public Hearing.

Mr. DiPersio stated that the applicant is proposing to build a 28,000 square foot industrial building on an undeveloped lot that is approximately 2.5 acres in the M-6 zoning district.  This site plan has been approved by the Internal Traffic Committee.  After the ITC reviewed the plans they noted that lighting and sign details need to be added to the plans as well as the location of the dumpster.  

Paula Thompson has reviewed the plans and had recommended some revisions which Mr. DiPersio has incorporated into the plans.  

This property is almost entirely within the Watershed Protection District and will require a special permit from the Zoning Board.  

The applicant would like to be able to have the ability to have a drive in bay as well as access to a dock on the other side.  The grading has been set up to accommodate this.  There will be three drive-in doors on the west side and four docks on the east side.  The traffic flow through the site will be one way which will be indicated by signage on the site.  

There is an existing six inch water and two inch domestic water stub onto the property.  The applicant is proposing they be extended into the building for fire and domestic service.  A new fire hydrant is being proposed within the right of way on the south side of Main Street.  

The drive-in bays call for floor drains in the building as there is no municipal sewer on this side of Town therefore a septic system has been designed to serve the building.  In order to drain the floor drains a tight tank will be installed.

Storm water will be managed through a ground water infiltration system at the front of the site.  The soils at this location are very amendable to this type of mitigation.  This will happen through the collection of storm water through storm drains and treatment by hydrodynamic separators that will discharge into a subsurface galley system at the front part of the site.

The ITC did note that the applicant will need a variance under section 7.1.6.2 (b) for the reduction in the required 120 foot turning radii for tractor trailer trucks.  Mr. DiPersio feels that the by-law is meant to say diameter and not radii as for a 120 foot radius a 250 foot wide parking lot would be required to accommodate a circle that large.  The applicant already has to go to the ZBA so this will be taken up at that meeting.  

Mr. DiPersio briefly went over the comments provided by Ms. Thompson.  The grading has been changed as it was slightly over the 3% maximum grade change.  The proposed retaining wall is 6 feet at its highest point.

Ms. Thompson noted that there are two parts of the drive way that will not be captured by the storm water management system, the trench drains will help with this.  The trench drains will need to be part of the operation and maintenance plan as these types of drains clog faster than normal catch basins.    

She briefly discussed other comments she had made in her letter and noted that Mr. DiPersio has addressed them all.  

Ron Müller reviewed the sight distance at the entrance and exit to the site and all the truck turning throughout the site.  

Bob Olsen, 569 Main Street noted that access to this property is currently available through his property, as there no frontal access, he would like assurance that once the building is complete the tendency to use this access is eliminated.  Ms. Thompson stated that there is six inch curbing along the property line.  The Board suggested boulders and / or landscaping could be used to add extra measure of deterrence.  

Dirk Underwood, seconded by Tom Collins, made a motion to close the public hearing for 571A Main Street.  

Vote: 4-0-0, Unanimous

Tom Collins, seconded by David Daigneault, moved to approve to approve the plan entitled “Proposed Site Plans 571A Main Street, Hudson, MA  01749” as drawn by Thomas DiPersio, Jr. & Associates of Marlborough, MA last revised February 3, 2016 and authorize the Agent to Sign with the following conditions:

  • A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW at the pre-construction conference.
  • Hours of operation will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m. in accordance with the Town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.
  • Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project site ceases for longer than 30 days, 48  hour written notice shall be given to the Planning Board Office prior to restarting the work.
  • A copy of this Decision and all final approved Plans shall be kept at the Project Site.
  • Members of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, regulations and directives of the Applicant or the Applicant’s contractors.  
  • The Planning Board’s erosion control plan as attached shall be adhered to and governed.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.
  • A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.
  • If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision the matter will be referred back to the Planning Board for review.
  • Prior to the issuance of a building permit the storm water calculations and applicable plan revisions must be approved by Waterman Design Associates (Town’s peer engineer).
  • Prior to the issuance of a building permit revised plans must show one way signage on the westerly parking lot.  
  • Prior to the issuance of a Building permit turning radius and sight distance must be approved by Ron Müller Associates (Town’s peer traffic engineer).  
  • Prior to the issuance of a Building permit an operation and maintenance plan must be submitted to the Planning Board.
  • Prior to the issuance of a Building permit proposed sign must be approved by the Planning Board.
  • Prior to the issuance of a Building permit proposed lighting details must be submitted to the Planning Board.
  • Prior to the issuance of a Building permit a proposed landscaping plan including boulders or other features to inhibit access to the adjacent property on the west must be approved by the Planning Board.
