Planning Board Minutes 12/12/15
Minutes of Meeting – December 15, 2015

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 PM, Bob D’Amelio called the meeting to order.

Present:        Bob D’Amelio, Rodney Frias, Tom Collins, David Daigneault Jack Hunter, Director, Kristina Johnson, Assistant Director and Teresa Vickery, Clerk.  

542 Main Street, Site Plan Review, Continued

The Board is in receipt of an email from Atty. Yates dated December 15, 2015 requesting a continuance to the Board’s next available meeting.

Rodney Frias, seconded by David Daigneault, made a motion to continue the public hearing for 542 Main Street until January 5, 2016 at 7:00 PM.

Vote: 4-0-0, Unanimous

304 Cox Street, Site Plan Review

Bob D’Amelio convened the public hearing.

The Board is in receipt of an email from Mr. Agnaldo Santos (applicant) dated December 12, 2015 requesting a continuance to the Board’s meeting of January 5, 2016.

Rodney Frias, seconded by David Daigneault, made a motion to continue the public hearing for 304 Cox Street until January 5, 2016 at 7:00 PM.

Vote: 4-0-0, Unanimous

1 Municipal Drive, Site Plan
Present was:    David McKinley, Kaestle Boos Architects
                 Paul Griffin, Construction Monitoring Services

Bob D’Amelio convened the public hearing.

Mr. McKinley explained this plan is for the new Police / DPW Headquarters building.  The building will be a single level 25,965 square foot structure.  The general area for the building had already been predetermined by the Town, however there were several constraints when considering the location.  There are wetland delineations and underground utilities as well as the location of the existing hockey rink that needed to be taken into account when weighing the site options.  Ultimately the chosen location was to the far east of the property off of Municipal Drive.  

There are 95 parking spaces for the Police and DPW.  There are two covered car ports as well as a six bay out building for storage and impound.  

The drainage system for the most part is an above surface system it doubles as a snow area as it is approximately 25 feet wide.  There are curbs along the outside of the parking area.  The curbs are broken every 60 feet.  At each break there is a rip rap swale to the bottom of the grass swale making it a low impact development treatment system where the water will be traveling along that area.  From there it will be directed underground to a system which will treat it and then release it into the wetlands.  

The antenna that is currently at the police station will be relocated onto the new building.  

Rodney Frias, seconded by Bob D’Amelio, made a motion to close the public hearing for 1 Municipal Drive.

Vote: 4-0-0, Unanimous

Rodney Frias, seconded by Tom Collins, made a motion to approve the site plan for entitled “Hudson Police and Department of Public Works Facility” as drawn by Kaestle Boos Associates, Inc. of Foxboro, MA dated November 5, 2015 with the following conditions and authorize the Agent to sign:
  • A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW at the pre-construction conference.
  • Hours of operation will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m. in accordance with the Town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.
  • Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project site ceases for longer than 30 days, 48  hour written notice shall be given to the Planning Board Office prior to restarting the work.
  • A copy of this Decision and all final approved Plans shall be kept at the Project Site.
  • Members of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, regulations and directives of the Applicant or the Applicant’s contractors.  
  • The Planning Board’s erosion control plan as attached shall be adhered to and governed.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.
  • A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.
  • If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision the matter will be referred back to the Planning Board for review.
  • A pre-construction conference shall be held prior to the commencement of construction, to include, at a minimum, the developer, engineer of record, a member of the Planning Department, the DPW, the Police Department and the Fire Department.

Vote: 4-0-0, Unanimous

Brigham Hill III, Extension to Complete Subdivision
Present were:     Niel Fossile, Ashbury Realty Trust
                        Linda DiLiddo, Ashbury Realty Trust

Mr. Frias recused himself.

The Board is in receipt of a letter dated November 16, 2015 from Ms. DiLiddo requesting an extension to complete the Brigham Hill III Subdivision.

David Daigneault, seconded by Tom Collins, made a motion to extend the time to complete the Brigham Hill III subdivision until November 1, 2017.

Vote: 3-0-1, Mr. Frias not voting.

Brigham Hill III, Bond Reduction Request
Present were:     Niel Fossile, Ashbury Realty Trust
                        Linda DiLiddo, Ashbury Realty Trust

Mr. Frias recused himself.

Mr. D’Amelio stated that the Board has not received anything from the DPW regarding the request.  Mr. Hunter noted that he has spoken to the engineer and made him aware that there is a punch list of things that must be completed before the bond is released.  

Mr. Hunter will meet with Mr. Fossile and Mr. Kamel.  The Board will revisit this on January 5, 2016.

The Board took no action.  

C-1 Zoning Discussion

Mr. Hunter stated that Town meeting had allocated $100,000 for purposes of rezoning and he feels that the C-1 District needs to be reviewed / revised.  A portion of this money ($8,300) has been used to hire Attorney Pamela Brown and Waterman Design to start redesigning the C-1 District zoning.  He is hoping to have a draft presentation ready for the last meeting in January.  

Mr. Hunter asked if one of the Board members could sit in on meetings regarding this as the Planning Board’s representative.  He noted that he had already approached Mr. Daigneault.  

Bob D’Amelio, seconded by Rodney Frias, made a motion to designate Mr. Daigneault as the Planning Board’s representative for c-1 discussions with Pamela Brown and Waterman Design Associates.

Vote: 4-0-0, Unanimous

Hazard Mitigation Plan Update
Present were:   Martin Pillsbury, MAPC
                Tanya Paglia, MAPC

The Town’s Hazard Mitigation Plan is being updated to help the Town reduce its vulnerability to natural hazard events such as flooding, hurricanes and winter storms.  Mr. Pillsbury presented the plan to the Board.  A copy of the presentation is on file in the planning office.

Bob D’Amelio, seconded by Tom Collins, made a motion to accept the minutes of November 17, 2015, as written.
