Minutes of Meeting – October 6, 2015

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 PM, Dirk Underwood called the meeting to order.

Present:        Dirk Underwood, Tom Collins, David Daigneault, Jack Hunter, Dir. Planning & Comm. Dev. and Teresa Vickery, Clerk.  

7 South Street, Site Plan Review, Cont.

Atty. Giannetti explained that since the last hearing for this project the Town’s engineer (Paula Thompson, Waterman Design Associates) has reviewed the project and supplied the applicant’s engineer with comments.  Mr. DiPersio stated based on the comments by WDA there were not a lot of notable revisions to the plans.  The majority of the comments were in regards to the storm water calculations.  A test pit was done on site in the location of the infiltration system in order to confirm that the soils that were used in the modeling were consistent with what is out there.  Some additional calculations have been provided as well as an operation and maintenance plan for the storm water system.  

The layout of the site, the building dimensions and the parking with regard to the site have not changed.  Mr. DiPersio noted that that parking lot on the western side of the site will be utilized by customers of the building.  The entrance width and the width of the drive aisle have been set at 24 feet.  Mr. DiPersio noted that in his opinion this width is the standard for two way access / egress in a parking lot.  He went on to say that he is very comfortable with this measurement.  The town’s requirement is normally 30 feet however there are no statutory requirement in the C-1 Zoning District.  The width of the parking spaces is 18 feet long and 8.5 feet wide.  The handicapped space meets ADA code making it van accessible.  The parking area at the back is reserved for the tenants of the building.  These spaces would not have a high volume of movement in and out during the day.  

Mr. Davis stated that the building will be four floors.  There will be a decking area on the top floor.  The lower floor would be higher ceiling floor for possible retail, restaurant or café uses.  The applicant is attempting to create a pedestrian link between Main Street and the multiple entrances to the building on South Street.  

Mr. Collins noted that the plans state that the lighting plan is being finalized.  He asked when the Board could expect to see it.  Mr. Davis stated that he will be working with an electrical engineer as well as a landscape architect to finalize all those details.  Atty. Giannetti stated that the applicant would not be adverse to leaving the issue open for the Board to revisit once the plans have been finalized.  

The approval will include a condition stating that the building permit will not be issued until lighting and elevation plans have been submitted and reviewed by the Planning Board.  

Mr. DiPersio explained that there will be substantial improvements made to the back end of the property.  

Mr. Hunter stated that he has contracted Atty. Pamela Brown to redo the zoning of the C-1 District.  The hope is that this will be ready to present to voters at the spring 2016 Town Meeting.  

Theodore Kasseris (local business owner) spoke in favor of the project and expressed his full support.  

Mr. Underwood noted that even though there is no requirement to add parking spaces he still struggles with it.

Mr. Daigneault also feels that it is a mistake to not include additional parking spaces and he stated that he does not like the project for this reason.  He then asked for comments from the other Departments regarding this project.  Mr. Hunter stated that they were supplied in the package and others were brought to the meeting.

Atty. Giannetti stated that the Internal Traffic Committee reviewed and approved this project in May.  

Tom Collins, seconded by David Daigneault, made a motion to close the public hearing for 7 South Street.

Vote: 3-0-0, Unanimous

Mr. Daigneault stated that the comments were not sufficient and would like to see more than what was supplied.  

Tom Collins, seconded by Dirk Underwood, made a motion to approve the plan entitled “7 South Street Hudson MA” as drawn by Thomas DiPersio, Jr. & Associates, Inc. of Marlboro, MA dated May 15, 2015 last revised September 24, 2015 and Authorize the Agent to sign with the following conditions:

  • A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW at the pre-construction conference.
  • Hours of operation will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m. in accordance with the Town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.
  • Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project site ceases for longer than 30 days, 48  hour written notice shall be given to the Planning Board Office prior to restarting the work.
  • A copy of this Decision and all final approved Plans shall be kept at the Project Site.
  • Members of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, regulations and directives of the Applicant or the Applicant’s contractors.  
  • The Planning Board’s erosion control plan as attached shall be adhered to and governed.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.
  • A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.
  • If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision the matter will be referred back to the Planning Board for review.
  • Prior to the issuance of a building permit the following shall be submitted and reviewed by the Planning Board; lighting plan, signage plan which shall include adding a stop sign at the exit to the site and all ADA parking signs, an updated and completed construction period pollution prevention plan, and building elevations.  
Vote: 2-0-1, David Daigneault against.  The motion failed.  

Mr. Hunter asked Mr. Daigneault why he voted against this site plan.  Mr. Daigneault stated that he wanted to see comments from the Internal Traffic Committee that state their approval of this project.  Mr. Hunter stated that if this is the only issue he can ask the Board to reconsider the vote and include this as a condition of approval.  

Tom Collins, seconded by Dirk Underwood, made a motion to withdraw the vote for 7 South Street and reconsider the issue.

Vote: 3-0-0, Unanimous

Tom Collins, seconded by David Daigneault, made a motion to approve the plan entitled “7 South Street Hudson MA” as drawn by Thomas DiPersio, Jr. & Associates, Inc. of Marlboro, MA dated May 15, 2015 last revised September 24, 2015 and Authorize the Agent to sign with the following conditions:

  • Prior to the issuance of a building permit all comments regarding this project from the Police Chief, Fire Chief, Building Commissioner and DPW Director shall be submitted to the Planning Board.
