Minutes of Meeting – February 3, 2015


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 PM, Bob D’Amelio called the meeting to order.

Mr. Frias convened the Public Hearing.

The applicant is proposing to expand the parking area at 312 Main Street on west side of the property.  There are currently two parking areas for this building; one on the east side and one on the west, the parking area on the east will not be altered in any way.  Currently there are 94 spaces on the west side with three handicapped spaces.  They are proposing to increase the parking by 83 normal spaces and three handicapped.  The total number of spaces will be 224 plus 7 handicapped.  

There is a right of way on the west side of the property that will be used as a second means of egress.  This right of way will be exit only and left turn only.  Atty. Giannetti noted that the ITC questioned who owned the right of way and instructed him to supply a deed which proves who the rightful owner is.  Atty. Giannetti has supplied the deed and it will be added to the project file.

Ms. Quinn discussed the grading and drainage plan.  She explained that there is an existing drainage system on the property that is functioning.  There is also an existing drainage easement along the south end of the property.  At the ITC meeting Mr. Marques required that the existing catch basin be replaced with a new full drain manhole as the initial plans proposed that only the cover would be changed.  The plans have been changed to reflect this change.  

There will not be any structures added on the drainage easement.  The proposed infiltration system will be approximately three feet outside of the drainage easement.  This system retains water and also filters it in a series of chambers.

The lot at the back of the property has been slightly raised in order to avoid having to erect retaining walls.  The drainage was also slightly reconfigured in order to eliminate the need for a retaining wall.  

There are currently two lights on each side of the site; one more will be added to each side.  Mr. Frias cautioned that the lighting on the west side be shuttered downward to lesson the impact to the residents of the esplanade.  

The snow storage area being proposed is 6.3% which is 1.3% more than the requirement.

Ms. Quinn did note that the open space is being reduced even further as it is currently pre-existing non-conforming.  However they are proposing to make it more non-conforming.  The requirement is 35%.  The existing open space is 26% but the applicant is proposing to decrease it to 13%.  Ms. Quinn stated that will be seeking relief from the Zoning Board of Appeals by way of a variance.  

There was no input from the public.

Dirk Underwood, seconded by Tom Collins made a motion to close the public hearing for 312 Main Street.

Dirk Underwood, seconded by Tom Collins made a motion to approve the site plan entitled “Permit Site Plan – 312 Main Street in Hudson, MA for Main & Tower Partners, LLC” as drawn by Hancock Associates of Marlboro, MA  01752 dated December 15, 2014 last revised January 30, 2015 and Authorize the Agent to sign with the following standard order of conditions:
 
A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW prior to any work being done on site.

Hours of construction will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m., in accordance with the town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.

Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project Site ceases for longer than 30 days, 48 hour written notice shall be given to the Planning Board Office prior to restarting work.

A copy of the conditions and all final approved Plans shall be kept at the Project Site.

Members or agents of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, Regulations and directives of the Applicant and the Applicant’s contractors.

The Planning Board’s erosion control plan as attached shall be adhered to and govern.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.

A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.

If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision, the matter will be referred back to the Planning Board for review.
