Planning Board Minutes 11/18/14
Minutes of Meeting – November 18, 2014


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 PM, Bob D’Amelio called the meeting to order.

Present: Bob D’Amelio, Dirk Underwood, Tom Collins, David Daigneault, Jennifer Burke,        Planning Director and Teresa Vickery, Clerk.

Present was:    Brian Falk, Atty. at Law

Atty. Falk explained to the Board that the plan shows two buildings on one lot the property owner is creating a lot line in order to produce a separate lot for each building.  A plan was filed in 1987 attempting to do the same thing however the plans were defective as the lot lines did not connect, this will eliminate the issue.   

Ms. Burke noted a letter from Hudson Light & Power regarding issues that need to be addressed before they can supply power to one of the lots.  The issue is that only one of the buildings has power and it is supplying power to the other as they were both owned by the same person.  Mr. Falk stated that he is working on resolving the issues brought up in the letter.  

Dirk Underwood, seconded by Tom Collins, made a motion to accept the plan entitled “Plan of Land in Hudson & Berlin, Massachusetts” as drawn by Thompson-Liston Associates, Inc., Boylston, MA and dated October 23, 2014 and Authorize the Agent to sign.

Vote: 4-0-0, Unanimous

Review & Adopt The Town of Hudson Master Plan
Present were:   Michelle Ciccolo, Director of Community Development     
                Kerin Shea, Community Development Assistant
                Ralph Wilmer, VHB Consultants

Ms. Ciccolo noted that she was happy to be present the Plan to the Board after two years of working on it.  She noted that there were many forums and public hearings held in order to highlight the different chapters of the plan.  Hundreds attended the sessions that were held and approximately 750 residents completed an online survey.  

There are two chapters in the Plan that are not typically addressed in a master plan that Hudson did choose to include; they are the public health chapter and the energy and sustainability chapter.
Ms. Ciccolo explained that the Plan does not implement itself.  Every implementation and/or action must involve other Boards and Committees.  There will be plenty of opportunity for the public to weigh in on the changes as they go through the proper channels and public process.

Mr. Wilmer stated this process was different than most others as the public forums were topic specific.  By including the chapters on public health and energy and sustainability the Plan shows how land use intersects with public health services as well as the issue of energy efficiency.  

Recommendations for the various chapters as well as a timeframe has been included in the back of the Plan and the Board/Committee responsible for the changes have been highlighted as well.  There are a lot of recommendations that pertain to the zoning by-laws as they the Town’s best implementation tool.  

Mr. D’Amelio commented on how great the public outreach was for the Plan.  Mr. Daigneault noted how thorough the Plan is.  

The Board thanked Ms. Ciccolo and Mr. Wilmer for the Plan and for how in depth it is.

David Daigneault, seconded by Tom Collins, made a motion to adopt Town of Hudson Master Plan dated November 2014.

Vote: 4-0-0, Unanimous

14 High Street: Site Plan Review
Present were:   Paul Giannetti, Atty. at Law
                Ron Mueller, Mueller Associates
                Paula Thompson, Waterman Design
                Matt Smith, Bohler Engineering

The applicant asked for a continuance to the Board’s meeting of December 2, 2014 at 7:00 PM as the entire Board was not present at the meeting.  They were prepared to proceed however opted to not give any testimony to the remaining four Board members.  Mr. D’Amelio noted that the Ms. Burke will be asking legal counsel to render an opinion regarding whether the absent member can sit and continue to hear testimony on this petition as he was not present at the previous meeting either.  

Atty. Giannetti noted for the record that the applicant is in full agreement with the Boards course of action.  

Dirk Underwood, seconded by Bob D’Amelio made a motion to continue the public hearing for 14 High Street to December 2, 2014 at 7:00 PM.  

Vote: 3-1-0, Mr. Daigneault against.
Bond Reduction Request: Brigham Hill III, Phase I

The Board is in receipt of a bond reduction request for Brigham Hill III, Phase I.  Mr. Fossile is requesting that the bond be reduced to $187,017.50.  The Board agreed to release the requested amount.  

Bob D’Amelio, seconded by Tom Collins, made a motion to reduce the amount of the bond leaving a remaining balance of $187,017.50 for Brigham Hill III, Phase I.

Vote: 4-0-0, Unanimous

Minutes

Dirk Underwood, seconded by David Daigneault, made a motion to accept the minutes of October 7, 2014, as written.

Vote: 4-0-0, Unanimous.
