Minutes of Meeting – April 1, 2014


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Bob D’Amelio called the meeting to order.

Present: Bob D’Amelio, Dirk Underwood, Rodney Frias, David Daigneault, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.


Amend Zoning By-Law: Floodplain / Wetland District
Mr. D’Amelio convened the public hearing.

Ms. Burke informed the Board that FEMA has changed the floodplain maps and it is now up to the Town to adopt the new maps and make any changes to the by-law prior to June 30, 2014 or the residents of Town will not be eligible for flood insurance.  In order to comply with this requirement a warrant article has been inserted into the Town Meeting warrant.

The elevation and the area of the floodplain have increased.  Ms. Burke is unsure as to which specific areas have been impacted, however the maps are available to view in the Inspections Office.  

Dirk Underwood, seconded by Rodney Frias, made a motion to close the public hearing.  

Vote: 4-0-0, Unanimous.

Rodney Frias, seconded by Dirk Underwood, moved to support the Article.

Vote: 3-1-0, David Daigneault against.


Amend Zoning By-Law: Medical Marijuana Treatment Centers Overlay District
Mr. D’Amelio convened the public hearing.

Ms. Burke explained to the Board that his By-Law will replace the moratorium that was put it place that the prior Town Meeting.  The moratorium expires on June 30, 2014.  Ms. Burke, Chief Stephens, Captain Burks and Sam Wong had worked together to find an area of Town to assign to this overlay district.  The LCI (Limited Commercial Industrial) District on the western end of Town has been designated for this purpose; this is the only area being proposed.  If this by-law is not passed before the moratorium expires then one of these facilities could be located anywhere in Town.  

Rodney Frias, seconded by Dirk Underwood, made a motion to close the public hearing.

Vote: 4-0-0, Unanimous

David Daigneault, seconded by Rodney Frias, moved to support the Article.

Vote:  4-0-0, Unanimous

ANR – 50 Parmenter Road
Present was:    Frank Vernooy, Applicant

Mr. Vernooy informed the Board that he is looking to shift lot lines to make the side setback more conforming by 6”.  The Board had no issues.

Rodney Frias, seconded by Bob D’Amelio, moved to accept the plan entitled “Plan of Land in Hudson, MA” as drawn by Hancock Associates of Marlboro, MA and dated February 4, 2014 and Authorize the Agent to sign.

Vote: 4-0-0, Unanimous

ANR – Zina Road
Present was:    Tom DiPersio, Thomas Land Surveyors

Mr. DiPersio explained that he wants to make a slight change to a plan that the Board approved in June 2013.  The property owner is looking to shift the lot lines which will only affect parcel B.

Rodney Frias, seconded by Bob D’Amelio, moved to accept the plan entitled “Plan of Land in Hudson, MA” as drawn by Thomas Land Surveyors and Engineering Consultants of Hudson, MA and dated March 24, 2014 and Authorize the Agent to Sign.

Vote: 4-0-0, Unanimous
