Planning Board Minutes 04/02/13
Minutes of Meeting – April 2, 2013


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Dirk Underwood, Tom Collins, David Daigneault, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Public Hearing – Rezone 139 Washington Street
Present was:    Paul Sushchyk, Atty. at Law
                Steven Grossman, Petitioner

Mr. D’Amelio convened the Public Hearing.

Atty. Sushchyk explained that the petitioner of the article and property owner Mr. Grossman is proposing a change to the zoning at the property located at 139 Washington Street.  This parcel is adjacent to the existing commercial zone along Washington Street.  This change was proposed in 2004 and was not voted for at Town Meeting.  The petitioner believes that the character of this area of the street has changed since then and it is has become more commercialized.  

The Finance Committee voted to support this article.

Mr. D’Amelio cautioned the petitioner that the Town is in the process of putting together a comprehensive master plan and the Board has concerns about changing any of the zoning in Town until the Master Plan is complete.  

Allyson Hay, 11 Maxwell Circle spoke against this article stating that this is spot zoning.  Denise Reid, 8 Brettonwood Road and Tom McAuliffe, 15 Maxwell Circle both spoke out against the article as well.  

Mr. Daigneault stated that he is not in favor of this change as the property was purchased as residential.  Mr. Underwood also spoke out against this zoning change.

David Daigneault, seconded by Tom Collins, made a motion to close the Public Hearing.

Vote: 4-0-0, Unanimous.

The Board took no action.

Public Hearing – Medical Marijuana Moratorium
Present was:    Chief David Stephens, Hudson Police Department
                Captain Michael Burks, Hudson Police Department
                Dr. Sam Wong, Hudson Board of Health Agent

Ms. Burke explained the purpose of the moratorium is to simply be able to temporarily hold off on allowing medical marijuana treatment centers in Town until the Department of Public Health (DOH) comes out with it’s regulations regarding this.  Once the regulations are reviewed the Town will determine the best course of action.  

Chief Stephens noted his concern that this is a cash only business and having excessive amounts of cash and drugs at these facilities is a public safety concern.  

There is a minimum of one per county.  

Steve Domenicucci, 9 Avon Drive asked in which district the facility would be located.  Ms. Burke stated that most likely it will be in one small area of Town.

This was unanimously supported by the Finance Committee.  

Dr. Wong spoke in favor of the moratorium.  He made the distinction that this is not for home grown medicinal marijuana it is purely for distribution purposes.  

Tom Collins, seconded by David Daigneault, made a motion to close the Public Hearing.

Vote: 4-0-0, Unanimous.

Brigham Hill III – Bond Reduction

The Board has a request to release the amount of $45,000 of the bond for Brigham Hill III to leave a remaining amount of $375,572.50.  

The Board took no action.

Dirk Underwood, seconded by Bob D’Amelio, made a motion to accept the minutes of February 19, 2013, as written.

Vote: 4-0-0, Unanimous
