Minutes of Meeting – November 20, 2012


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Dirk Underwood, Tom Collins, David Daigneault and Teresa Vickery, Clerk.

81 High Street, Preliminary Subdivision
Present were:   Tom DiPeriso, Sr., Thomas Land Surveyors
                Anamal Islam, Applicant

Mr. D’Amelio convened the public hearing.

Mr. DiPersio explained that this plan is a follow up to the previously submitted conceptual plan for 81 High Street.  At the end of the last meeting it was agreed that more detail would be added to the plans.  These plans show the location of the two houses on the west side of the High Street extension.  The contours throughout the property have added based on a field survey.  

This is a 34,000 square foot parcel of land which the applicant is proposing to create a second house.  Each of the lots will have more than the required 15,000 square feet.  The second house will be constructed on the east end of the property.  

The road will be 18 feet wide with a T- turnaround that meets the required turning radius.  Catch basins will be added to mitigate any new runoff.  The new house will be serviced by the existing sewer main.  

Mr. D’Amelio noted that in the past when the Board has waived the building of a cul-de-sac the applicant was always able to build the required roadway.  In this case the cul-de-sac cannot be built per the Towns rules and regulations.  Mr. D’Amelio stated that for this reason he will not approve the waiver for the cul-de-sac.  

James Garrity, 9 Elm Street explained that the water is being directed down hill straight into his backyard.  Mr. DiPersio stated that all drainage issues will be addressed at the definitive stage.  

Susan Mungeam, 11 Blossom Street expressed concern for the water pressure.  Again Mr. DiPersio said this would be addressed at the definitive stage.

After some discussion the Board unanimously agreed that they would not be inclined to grant the waiver for the cul-de-sac.

Mr. D’Amelio, seconded by Mr.  Underwood, made a motion to close the public hearing and deny the preliminary plan for 81 High Street based on the following finding:

1.  The Board is not willing to waive section 4.1.5.2 of the Planning Boards rules and regulations therefore the applicant cannot meet the construction requirements for the cul-de-sac.

Vote: 4-0-0, Unanimous.
