Planning Board Minutes 07/17/12
Minutes of Meeting – July 17, 2012


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Dirk Underwood, Tom Collins, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

141 & 153 Broad Street, Site Plan Review Cont.

At its last meeting the Board had asked the applicant for additional information.  This information is to be forwarded on to the Town’s engineering consultants for review.  The information was received this afternoon and the consultant has not had time to review them.  For this reason Mr. D’Amelio asks that the public hearing be continued.

Tom Collins, seconded by Dirk Underwood, made a motion to continue the public hearing for 141 & 153 Broad Street to August 4, 2012 at 7PM.

Vote: 3-0-0, Unanimous

81 High Street, Preliminary Subdivision
Present were:   Patrick Roseingrave, CCR Associates     
                Anamul Islam, Applicant

Bob D’Amelio convened the public hearing.

Mr. Roseingrave explained to the Board that the applicant is proposing to subdivide a 36,000 square foot lot into three parcels.  The parcels are made up of the existing parcel (Parcel B), the proposed lot (Parcel A) and the existing access road (Parcel C).  

There is a sewer line in front of the lot as well as a utility pole and a water main and hydrant.  The access road will be paved an additional 82 feet to help with drainage.  There is no parking provided on the plans as there is no on street parking allowed.  

Mr. Roseingrave said they will go out and dig a test pit to properly design the drainage so as to not have water flowing down the street.  The revised plans show a snow storage area.  

Mr. D’Amelio asked that grading be shown on the plans as well as the location of the existing homes.  

Kathleen Drummey, 82 High Street asked if the Town would continue to plow the road.  Mr. D’Amelio said he will address this with Tony Marques.  

Nancy Miller D’Amico, 16 Blossom Street asked if the road is widened will it impact her property.  Mr. D’Amelio stated that they don’t yet know if the road will be widened.  

Al Mungeam, representing Sue Mungeam, 11 Blossom Street said that as it is the snow plows do not have enough room to turn around and he feels this will make matters worse.  

Nancy Garrity, 9 Elm Street noted that drainage is a problem.  Mr. D’Amelio stated that all these issues will be discussed with the DPW.

Jack Drummey, 6 Bush Road also noted concern for the drainage.  

Mr. D’Amelio explained to Mr. Roseingrave that his client can either address these issues in a definitive plan or come back with an updated preliminary plan.  After conferring with his client Mr. Roseingrave stated that they would take the comments and proceed with a definitive plan.  

Dirk Underwood, seconded by Bob D’Amelio, made a motion to close the public hearing for 81 High Street.

Vote: 3-0-0, Unanimous

Dirk Underwood, seconded by Tom Collins, made a motion to accept the entitled “Preliminary Plan, 81 High Street Hudson MA” as drawn by CCR Associates of Quincy, MA dated June 4, 2012 and revised June 12, 2012.

Vote: 3-0-0, Unanimous

Brigham Hill III Discussion
Present were:   Michael Norris, Atty. at Law
                Niel & Geraldine Fossile

The Board is in receipt of a legal opinion from Town Counsel which states that under the 2010 Permit Extension Act Mr. Fossile’s time to complete the Brigham Hill III subdivision will be extended to November 30, 2013.  

Atty. Norris presented two modification requests to the Board for consideration.  The first request is relative to the paving of Parcel D which is the access to the ARRT instead of requiring paving at time of first occupancy he would like to pave when he is paving Exeter Road.  After discussion regarding liability and other issues the Board took the request under advisement for discussion with Town Counsel.  

The second request is the previous request regarding allowing all the lots to tie into Town sewer.  Mr. D’Amelio noted that because this was the result of an agreement to settle a law suit he is not sure of the Board’s jurisdiction to modify the condition he would like to see a meeting take place between parties involving including the Executive Assistant, Town Counsel and the Board of Health Agent.  Mr. Norris had no issue with this but his client requested the release of building permits the Board indicated that until the meeting takes place they are not comfortable issuing permits for lots affected by this issue. Mr. Norris said he would contact the Executive Assistant upon his return from vacation.
