Minutes of Meeting – May 15, 2012


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Rodney Frias, Dirk Underwood, Tom Collins, David Daigneault, Aldo Cipriano, Town Counsel, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Mr. D’Amelio began by informing the applicant that the site plan expired in November 2011.  He explained that this is no longer an existing subdivision and the applicant will need to re-file with the Board and go through all the required steps for subdivision approval.  The Board will allow the applicant to continue work on the subdivision until July 1, 2012.  If a new plan has not been submitted by this date the subdivision will be in default.  

Atty. Cipriano interjected, stating that the applicant has no choice but to re-file as the Board “can’t extend or modify that which has been expired or defaulted.”  He went on to say that it would be unreasonable for the Board to stop work at the site.  However, the re-filing would need to be done within a reasonable amount of time to ensure this.   

Atty. Norris asked if a full filing needs to be submitted.  Mr. D’Amelio said yes and it would need to show as-builts and existing conditions which are different than the expired / original subdivision plans.  

The Board took no action.

141 & 153 Broad Street- Site Plan Review, Cont.
Present was:    Scott Hayes, Foresite Engineering, representing Wildwater Development

Since the applicant was last before the Planning Board they have submitted a revised set of plans.  They were revised because of a legal opinion from Town Counsel regarding the surrounding wetlands.  Wildwater Development has contacted Ilda Esteves of 161 Broad Street and has an additional 50 foot strip of land under agreement.  This is to strip the access driveway around the 25 foot buffer zone which would limit the work in the watershed overlay district.  

Mr. Hayes continued to explain some of the changes to the plan.  Essentially everything was moved outside of the 25 foot buffer zone.  

Mr. D’Amelio explained that this plan will be sent off to the Town’s consulting engineer for further review and the public hearing will be continued to a date and time certain.  

Alberta Gallante, 135 Broad Street asked if the Board received a letter from Sandy Bouchard of 18 Overland Street.  Mr. D’Amelio explained that the issues that Ms. Bouchard noted in her letter fall under the prevue of the Zoning Board of Appeals.  

Corrine Bouchard, representing her mother Sandy asked about the walking path that was previously proposed.  Mr. Hayes explained that it was met with such resistance at the last meeting that the path has been removed from the plan.  

Jason Kunicki, 135 Broad Street asked if there are any type of subdivision issues with regards to the strip of land the Developer is purchasing from Ms. Esteves.  Mr. D’Amelio said that the Board will require a copy of the purchase and sales agreement to ensure that this exchange happened.  An ANR plan will need to be filed to reflect the new lot lines after this plan is approved.

Mr. Kunicki asked what the status of the privacy fence is.  Mr. D’Amelio said that this is a long way off however the request has been noted by the Board and will be discussed down the road.

The plans will be sent off to SEA for peer review.  The review will not start until a check is received from the Developer.

David Daigneault, seconded by Dirk Underwood, made a motion to continue the public hearing for 141 & 153 Broad Street until June 19, 2012 at 7PM.

Vote:  4-0-1, Rodney Frias not voting.

Tom Collins, seconded by David Daigneault, made a motion to accept the minutes of May 1, 2012 as written.

Vote: 4-0-0, Unanimous
