Minutes of Meeting – May 1, 2012


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Rodney Frias, Dirk Underwood, Tom Collins, David Daigneault, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Planner’s Report

141 & 153 Broad Street- Site Plan Review, Cont.

The Board is in receipt of a letter from the applicant requesting a continuance to the Board’s next meeting.  The applicant is revising the plans due to the recent legal opinion received from Town Counsel.  The developer is asking if the Board would like to see the revised plans before SEA’s review.  The Board would like to see the revised plans at its next meeting.

David Daigneault, seconded by Tom Collins, made a motion to continue the public hearing for 141 & 153 Broad Street until May 15, 2012 at 7PM.

Vote: 5-0-0, Unanimous

70 Felton Street – Site Plan Review
Present was:    Thomas DiPersio, Jr., Thomas Land Surveyors

Mr. D’Amelio convened the Public Hearing.

Mr. DiPersio noted that this is an existing half acre lot with a six unit apartment building and a one unit building on the property.  Currently the parking is an unpaved gravel area.  The applicant is proposing a formal parking lot to serve the seven units.  The proposed lot will be comprised of a total of 18 spaces.  

Mr. DiPersio noted that they are proposing storm water mitigation measures as part of the plan.  Catch basins and an infiltration system will be installed at the low end of the lot.  This will collect all the runoff from the parking lot and will be infiltrated on site.  

The applicant will need to apply for a variance for the aisle width as they are required to be 30 feet and the plans shows the spaces will be 22 feet in width.  Ms. Burke noted that the ITC did not have any issue with the width of the drive aisles at this location.  

There was a brief discussion regarding a letter from the Board of Health stating that this is an area with a high water table.  Mr. DiPersio does not agree stating if that were the case the field would be flooded.  The Board agreed that a  letter from Tony  Marques stating that the drainage is sufficient will be acceptable and added to the file.

There was no input from the public.  

Tom Collins, seconded by Dirk Underwood, made a motion to close the public hearing for 70 Felton Street and approve the plan entitled “Site Plan of Land in Hudson, MA” as drawn by Thomas Land Surveyors and Engineering Consultants of Hudson, MA and dated April 2, 2012 with the following findings:


  • There is adequate protection of the adjoining property against detrimental or offensive uses on the site.
  • The convenience and safety of vehicular traffic and pedestrian movement within the site and in relation to the adjacent streets is adequate.
  • There are adequate methods of disposal of sewage refuse and other wastes resulting from uses permitted or permissible on the site and methods of drainage for surface water.
  • There is adequate space for off street parking, loading and unloading of vehicles, goods, products, materials and equipment incidental to the normal operation of uses permitted or permissible.
  • There is adequate control of lighting, sound emissions and odor emanating from the site.
And conditions:

A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW prior to any work being done on site.

Hours of construction will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m., in accordance with the town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.

Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project Site ceases for longer than 30 days, 48 hour written notice shall be given to the Planning Board Office prior to restarting work.

A copy of the conditions and all final approved Plans shall be kept at the Project Site.

Members or agents of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, Regulations and directives of the Applicant and the Applicant’s contractors.

The Planning Board’s erosion control plan as attached shall be adhered to and govern.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.

A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.

If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision, the matter will be referred back to the Planning Board for review.

A letter will be received by Tony Marques stating that the drainage proposed will be adequate.

Vote 5-0-0, Unanimous

Post Meeting Note: After additional review of the zoning by-law, the Building Commissions determined that a variance is not needed for the width of the internal drive aisles.  Therefore the condition has been removed from the final decision.

Mr. Frias left the meeting.

81 High  Street – Site Plan Review
Present was:    Patrick Roseingrave, Land Mapping, Inc.

Mr. D’Amelio convened the public hearing.

The Board explained that the application that was submitted is incomplete and therefore would have to deny the site plan on the basis of the lack of information.

Richard Miller’s daughter (representing her father), 16 Blossom Street asked for clarification regarding the number of lots.  Mr. D’Amelio noted that it is unclear as the plans do not sufficiently address this.  

James Garrity, 9 Elm Street had some concerns regarding the runoff of salt and sand which would run down the hill to his property.  Again the Board noted that this plan will be denied however the abutters concerns may help the applicant if he chooses to resubmit the plan in the future.  

Dirk Underwood, seconded by Tom Collins, made a motion to close the public hearing for 81 High Street.

Vote: 4-0-0, Unanimous

Tom Collins, seconded by Dirk Underwood, made a motion to deny the site plan entitled “Subdivision Plan 81 High Street, Hudson, MA” as drawn by Land Mapping, Inc. of Randolph, MA dated March 28, 2012 based on the following finding:

  • Lack of information.
