Minutes of Meeting – March 20, 2012


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Rodney Frias called the meeting to order.
Present:        Rodney Frias, Tom Collins, Dirk Underwood, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.

Planner’s Report

JFK Storm Drainage Modifications

Ms. Burke informed the Board that she has received a letter dated March 7, 2012 from OMR Architects noting site plan modifications to the drainage system.  The Board feels the requested modifications are minor.

The Board took no action.

350 Main Street, Site Plan Review
Present was:    Halim Choubah, Choubah Engineering Group

Mr. Frias convened the Public Hearing.

Mr. Frias informed the Board that he has filed a disclosure with the Town Clerk stating that he is related to the applicant’s wife; however, has no financial interest in the project.

Mr. Choubah explained that this application is for site modification to the existing site.  The existing retail space on the lot measures 340 square feet, the applicant is proposing to knock it down and construct a 2,096 square foot retail space with a drive through located on the northwest side of the building.  

There are five dispensing fuel pumps on the site.  The property is located in the C-10 district which permits retail businesses and gas stations as allowable uses.

Access to the site is via two existing curb cuts on Main Street and one on Tower Street.   The plans show the elimination of one of the curb cuts that is closest to the intersection.  

The parking on site meets the requirement per the zoning by-laws.  There are 15 parking spaces on the site (8 of which are at the pump and can be included in the count).  

Mr. Underwood asked if the drive through would be serving food.  Mr. Choubah explained that at this time there is no plan to utilize the drive through and no food would be prepared or served.

Mr. Frias stated that he would like that the fuel be delivered off peak hours.  Mr. Salem explained that the fuel is traditionally delivered off peak hours as to not interfere with his customers.  Mr. Underwood added that delivery on off peak hours be for all deliveries not just the fuel.

Mr. Frias noted a memo from the Board of Health requesting a cross walk on Main Street across from the rail trail to the property.  Mr. Choubah agreed and said he would coordinate this with Tony Marques.  Mr. Frias told Mr. Choubah that it would be Mr. Marques’ decision as to whether he wants to put a cross walk there or not.  

Tom Collins, seconded by Dirk Underwood, made a motion to close the public hearing for 350 Main Street and approve the plan entitled “Proposed Modifications 350 Main Street, Hudson, MA” as drawn by Choubah Engineering Group, P.C. of North Dartmouth, MA and dated January 3, 2012 with the following conditions:

A list of 24-hour emergency contact information must be provided to the Planning Director and the DPW prior to any work being done on site.

Hours of construction will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m., in accordance with the town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.

Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project Site ceases for longer than 30 days, 48 hour written notice shall be given to the Planning Board Office prior to restarting work.

A copy of the conditions and all final approved Plans shall be kept at the Project Site.

Members or agents of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, Regulations and directives of the Applicant and the Applicant’s contractors.

The Planning Board’s erosion control plan as attached shall be adhered to and govern.  All erosion control shall be in place and approved by the Planning Director before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noon time on Fridays.

A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Planning Director’s reasonable satisfaction.

If, during construction, a discrepancy is found between the approved plans and the existing regulations, the DPW and the Planning Director will be notified immediately.  The DPW will make the final decision on how to proceed or if they are unable to make any decision, the matter will be referred back to the Planning Board for review.

A pre-construction conference shall be held prior to the commencement of construction, to include, at a minimum, the developer, the Planning Director, the DPW, the Pole Department, the Fire Department and a representative from the Conservation Commission.

All deliveries to the site will be limited to off peak hours.


A crosswalk is to be painted on Main Street across from the RailTrail to the property subject to Tony Marques’ consultation and approval.
