Minutes of Meeting – October 18, 2011


The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Bob D’Amelio called the meeting to order.
Present:        Bob D’Amelio, Rodney Frias, Tom Collins, Dirk Underwood, Jennifer Burke, Planning Director and Teresa Vickery, Clerk.


Public Hearing: Zoning By-Law Amendment – Prohibited Uses

Bob D’Amelio convened the Public Hearing.

Ms. Burke explained that the previous wireless communications facility by-law restricted the height of the communications tower to 100 feet.  Last November the by-law was amended to increase the tower height to 120 feet.  Previously there was a separate section in the by-law, 5.1.5.2, which states that all radio and television transmission towers in excess of 100 feet is prohibited in all districts.  Ms. Burke noted that this section contradicts the amended by-law and it needs to be removed from the by-law.

There were no comments from the public.

Rodney Frias, seconded by Dirk Underwood, made a motion to close the Public Hearing for the Zoning By-Law Amendment.

Vote:  4-0-0, Unanimous

Public Hearing: Zoning By-Law Amendment – District Change

                  Thomas DiPersio, Jr., 265 Washington Street
                  Nancy Girard, 263 Washington Street

Bob D’Amelio convened the Public Hearing.

This article is being sponsored by the two property owners at 265 & 263 Washington Street (named above).  Mr. DiPersio explained that they are proposing an extension of the existing commercial district (C-12) to include their two properties.  These are properties are currently in the SA-8, which runs down to the Hudson – Marlboro town line.  

Mr. DiPersio is hoping to get the support of the Planning Board.  Mr. Frias noted that during the time he has been a Board member the Board has never endorsed a zone change.  

Cynthia Gaudere, 5 Vernon Drive, asked if these changes in zoning are approved at Town Meeting what would happen if either of the applicants sold their property.  Mr. DiPersio stated that once this zone change is voted at Town Meeting it would remain commercial regardless of who owns it.  

Thomas Doerr, 2 Vernon Drive, urged the Board not to approve.  Mr. D’Amelio explained that this is not before the Board for approval.  The approval of this will be up to the residents of Hudson at the upcoming Town Meeting.  The Board must hold a Public Hearing as a required step in the process.

Steve Domenicucci, 9 Avon Drive, asked if this zoning change would benefit the Town.  Mr. DiPersio explained that this would increase the tax base for the Town.  Currently these two properties are taxed half residential and half commercial.  However, the Girard’s property would only be taxed commercial if they were to change or sell to a business.  

Rodney Frias, seconded by Dirk Underwood, made a motion to close the Public Hearing for the Zoning By-Law Amendment.

Vote:  4-0-0, Unanimous

The Board took no action.

Planner’s Report

Master Plan Steering Committee Names

Ms. Burke informed that Board that another name has been added to the list.  Mr. Arthur Redding will be the representative of the Historic Commission, the alternate is James Quinn.  Ms. Burke stated that if there are no objections she will forward the list to the Board of Selectmen for their approval.

Sign Betterments for sewer main installations

The Board of Selectmen approved the betterments at its last meeting and they need to be signed by the Planning Board agent so they can be recorded.

Bob D’Amelio, seconded by Rodney Frias, made a motion to sign the betterments for sewer main installations for Brigham Street, Four Bridges Road, Rolling Lane, Rathburn Road, River Road and Chapin Road and Authorize the Agent to sign.

Vote: 4-0-0

Dirk Underwood removed himself from the Board.

Update on Chestnut Hill Estates Extension

Ms. Burke informed the Board that she received a call from an Attorney, Bob Dionisi, who represents the developer/owner of the previous subdivision.  The Developer said that there had been an agreement between himself and the Underwood Family to allow the extension.  The Attorney had a lot of concerns about what the future will bring regarding the proposed subdivision.  Ms. Burke met with Town Counsel to discuss the issue.  

Dirk Underwood returned to the Board.

Minutes

Tom Collins, seconded by Dirk Underwood, made a motion to accept the minutes of September 20, 2011.

Vote: 4-0-0, Unanimous
