Minutes of Meeting – August 5, 2008

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:30 p.m., Robert D’Amelio called the meeting to order.

Ms. Burke noted that the applicant is just reducing the size of lot 10B.  It will still be a buildable lot but this will give her more flexibility in the design of the subdivision.  The Board had no issues with the change.

Dirk Underwood, seconded by Tom Collins, moved to accept the plan entitled, “Approval Not Required Plan of Land in Hudson, MA”  owned by Evergreen Homes of Marlborough, MA as drawn by Thomas Land Surveyors & Engineering Consultants of Hudson, MA dated July 15, 2008 and Authorize the Agent to sign.

Vote: 3-0-0, Unanimous

Planner’s Report

Mr. D’Amelio noted that work has been progressing on site.  He asked Mr. Norris to reiterate the proposal for completion.   Mr. Norris sated that his client proposes to finish Judith Road within 90 days.  He then needs some additional cash flow to finish Shelly Lane.  So he proposes the after 3 more sales he would be able to finish Shelly Lane.  Likely in about 1 year.

Mr. Norris noted that Avidia Bank is also working with Mr. O’Malley to get the project completed.

Mr. Underwood asked what guarantees there were that the whole subdivision will be complete in 1 year.  He was told none.

Mr. D’Amelio asked how many unsold lots were left fronting on Judith Road.  He was told 4.

Mr. O’Malley mentioned that at the previous meeting he was asked to look into why the electric boxes were flooding.  He investigated the situation and stated that there is a double catch basin sealed per the order of the Conservation Commission.  Some regrading has been done in the area and it should not flood the boxes again.

There was a discussion regarding the end of Judith Road.  The plans show a temporary cul-de-sac.  It was always the intention that it would be a permanent turn around.  The Board is in receipt of letters from DPW and the Fire Department indicating the need for the permanent turnaround and necessary easements.  Mr. O’Malley agreed.

Mr. Collins asked about the status of Shelly Lane through the winter months.  Mr. O’Malley will mostly block it off but will need to provide some access for utilities.

The Board would like to move forward with getting Judith Road paved by November 1, 2008.  Atty. Cipriano noted that the Board should condition the permanent cul-de-sac as part of the extension.

Bob D’Amelio, seconded by Tom Collins, moved to extend the time to complete Judith Road until November 18, 2008 with the condition that the cul-de-sac at the end of Judith Road be a permanent cul-de-sac with the appropriate easement forwarded to DPW for review.

Vote: 3-0-0, Unanimous

Mr. O’Malley will return to the Board’s meeting on November 18, 2008 for a status update and to discuss Shelly Lane.

145 Main Street – Site Plan Review

Mr. D’Amelio convened the public hearing.  

The Board had no questions regarding the site plan and felt it would be an improvement to the existing conditions.


There was no input from the public.

Bob D’Amelio, seconded by Tom Collins, made a motion to approve the site plan entitled “Proposed Site Plan 145 Main Street and 4 Houghton Street Hudson Massachusetts” as drawn by Zanca Land Surveyors, Inc. of Stow, MA dated May 16, 2008 last revised July 1, 2008 with the following conditions:

A list of 24-hour emergency contact information must be provided to the Town Planner and the DPW prior to any work being done on site.

Hours of construction will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m., in accordance with the town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.

Prior to the commencement of authorized site activity, the Planning Board Office shall be given 48 hours written notice.  If the activity at the Project Site ceases for longer than 30 days, 48 hour written notice shall be given to the Planning Board Office prior to restarting work.

A copy of the conditions and all final approved Plans shall be kept at the Project Site.

Members or agents of the Planning Board shall have the right to enter the Project Site and to gather all information, measurements, photographs or other materials needed to ensure compliance with this approval.  Members or agents of the Planning Board entering onto the Project Site for these purposes shall comply with all safety rules, Regulations and directives of the Applicant and the Applicant’s contractors.

The Planning Board’s erosion control plan as attached shall be adhered to and govern.  All erosion control shall be in place and approved by the Town Planner before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.

A final occupancy permit shall not be issued until an as-built plan indicating lot grading and drainage system BMP’s has been confirmed to be consistent with the approved plans to the Town Planner’s reasonable satisfaction.

The building owner shall be responsible for allocation and monitoring the stacked parking area.  Said stacked parking to be used by tenant employees only.

And authorize the Agent to sign.
