Planning Board Minutes 05/20/08
Minutes of Meeting – May 20, 2008

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:30 p.m., Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Tom Collins, Dirk Underwood, James Vereault, Jennifer Burke, Town Planner and Teresa Vickery Clerk


Planner’s Report

-Form J2 – Lot Release – Julian Lane

Tom Collins recused himself.

Ms. Burke informed the Board that F&C Construction would like to release lot #2 in order to allow someone else to purchase the land.  There is a tri-partite agreement in place, however there should not by any issues with this.  Ms. Burke cautioned Mr. Collins if he wants to build on the two additional lots he would need to come back before the Board for approval.  Mr. Collins understood this.  

Bob D’Amelio, seconded by Dirk Underwood made a motion to approve the lot release lot #2 on Julian Lane from the covenant.

Vote: 3-0-0, Unanimous

Tom Collins returned to the Board.

ANR – 35 Old North Road
Present were:   Tom DiPersio, Sr.
                Edmund Barton

Mr. DiPersio explained to the Board that the Developers for Old North Woods are selling a 10-foot strip of land to Mr. Barton.  This would leave him with proper frontage and side yard and would make his existing non-conforming property more conforming.

James Vereault, seconded by Bob D’Amelio, made a motion to accept the ANR for 35 Old North Road and Authorize the Agent to Sign.

Vote: 4-0-0, Unanimous



Regulations Governing the Subdivision of Land, Storm Water Amendment

Mr. D’Amelio convened the public hearing.
Max Kamel, Assistant Director of the  DPW made his presentation to the Board.   He explained that the Town has a 5-year period in which to comply with new regulations regarding discharge permits for subdivisions.  These sub-division control regulations are mandated by the EPA and the DEP.  Mr. Kamel stated that if a section was inserted into the Planning Board’s regulations this would bring the Town up to compliance.  The regulation would state that in order to perform any work on an area over 1 acre the applicant must appear before the Board.  

Mr. Vereault asked whether outstanding water resources (ORW’s) could be defined by the Town not just the DEP.  Ms Burke said that at a later date a local ORW list could be complied and the Planning Board could then review it.

There was no input from the public.

James Vereault, seconded by Tom Collins, made a motion to close the public hearing.

Vote: 4-0-0, Unanimous

James Vereault, seconded by Tom Collins, made a motion to insert a new section 4.9.4.7 entitled “Rules and Regulations governing construction, post-construction erosion and sediment control for storm water management plan of new development and redevelopment” into the subdivision control regulations.

Vote: 4-0-0, Unanimous

Cancel Meeting

Dirk Underwood, seconded by Bob D’Amelio, made a motion to cancel the Planning Board meeting for June 3, 2008.

Vote: 4-0-0, Unanimous

Minutes

Bob D’Amelio, seconded by Dirk Underwood, moved to approve the minutes of April 1, 2008, as corrected.

Vote: 4-0-0, Unanimous
