Planning Board Minutes 10/18/07
 Minutes of Meeting— October 18, 2007

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:00 p.m., Chairman Robert D’Amelio called the meeting to order.
Present:        Tom Collins, Robert D’Amelio, Dirk Underwood, James Vereault, Aldo A. Cipriano, Town Counsel and Jennifer Burke, Town Planner

Indian Farm Estates– Definitive Subdivision
Present was:    Tom DiPersio, Thomas Land Surveyors

                Robert Dionisi, Atty. at Law

Atty. Cipriano reviewed the history with the Board and briefly outlined the process.  He noted that this is a modified plan which is still under judicial monitor.  The court case has been continued until October 29, 2007 and the attorneys may be able to get and additional 30-45 days.

Mr. D’Amelio noted that the DPW has presented a memo stating that the plans are unreadable.  The DPW needs to have readable plans to proceed.

Mr. DiPersio presented the plan to the Board.  The road length is 1050 feet.  They created a large lot at the end of the cul-de-sac.  The applicant is undecided on the status of the lot.  No looping of the water line is proposed.  There were some concerns noted regarding the sewer pump station.  He noted that the DEP and the DPW will be required to review and approve the design of the station.  He also noted that they will be filing with Berlin for the entrance of the subdivision and that the house locations of the plan are schematic only.  Finally he noted that the detention basin remains unchanged from the larger road which now makes it a conservative design for this plan.

Mr. D’Amelio noted letters from SEA and the DPW.  There are several engineering items that need to be addressed.  Mr. DiPersio indicated he didn’t think there were any issues that couldn’t be worked out.  The Board would like all parties to meet to work out the engineering issues.

Dan Jenkins, 202 River Street, asked if the new length is within the Planning Board regulations.  He was told no.  Mr. Resendes stated that the Board has waived other road lengths.  Mr. Jenkins asked what the justification is for the Board to waive the length.  Mr. D’Amelio stated that is the heart of the issue.

Jane MacDonald, 198 River Street, stated her opposition to the project and expressed concern for environmental protection as well as potential traffic created by the new road.



The Board noted that the Fire Chief and Police Chief have been on vacation and have no responded to the Board’s request for comments.  The Board hopes to have the comments next week.  Several members of the Board would like to wait until those letters are received until deciding on the road length.

It was noted that a waiver request to reduce granite curbing was not asked for but would be needed.

Liz Sommer, SEA Consultants, noted for the Board that she needed guidance relative to her comment # 12.  Some of the driveways (about 4000 square feet) do not drain to the street which does not comply with the Mass DEP Stormwater guidelines.  The Board would like to see the applicant comply.

Bob D’Amelio, seconded by Dirk Underwood, made a motion to continue the public hearing for Indian Farm Estates until October 25, 2007 at 7:00 p.m.
