Planning Board Minutes 04/04/06
Minutes of Meeting— April 4, 2006

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:30 p.m., Chairman Robert D’Amelio called the meeting to order.
Present:        Sante Parente, Dirk Underwood, Tom Collins, Rodney Frias, Robert D’Amelio and Town Planner, Jennifer Burke

Planner’s Report

River’s Edge Estates

The Board is in receipt of a review letter from SEA regarding the drainage.  Al Wells has determined that there is not a major change to the drainage design.

Rodney Frias, seconded by Dirk Underwood, moved to accept the change in the drainage design as a minor modification to the subdivision plans.

Vote: 4-0-1, with Sante Parente abstaining

Ms. Burke reviewed a request from the developer to look at condition #17.  Currently the condition indicates that Parcel B will be protected prior to any occupancy.  The developer would like it to read prior to final occupancy.  The Board sees no issue with that change.

Rodney Frias, seconded by Tom Collins, made a motion to change condition #17 to read “Parcel “B” as identified on the subdivision plans will be permanently protected by a Conservation Restriction governed by the Hudson Conservation Commission or by agreement with Sudbury Valley Trustees, or similar organization prior to the issuance of the final occupancy permit; further said restriction shall not prohibit passive access to the property by the public.”

Vote:   4-0-1 with Sante Parente abstaining

66 Laurel Drive

The Board is in receipt of a request from Chris Yates to release 66 Laurel Drive from the original covenant.  The subdivision has been completed and the road has been accepted by Town Meeting.

Dirk Underwood, seconded by Sante Parente, moved to release Lot 38 (66 Laurel Drive) from the Danforth Woods II subdivision covenant.

Vote: 5-0-0, Unanimous

ANR

Parmenter Road

Mr. DiPersio presented the plan to the Board.  The plan cleans up the lot lines so that the house can be sold.

Dirk Underwood, seconded by Rodney Frias, moved to accept the plan entitled “Plan of Land in Hudson, MA” owned by Dorothy M. Balben as drawn by Thomas Land Surveyors of Hudson, MA dated March 3, 2006 and authorize the Agent to sign.

Vote: 5-0-0, Unanimous

Zoning By-Law Amendment

Mr. D’Amelio announced that the Board has decided to ask Town meeting to pass over the article.  After a brief discussion the public hearing continued in case Town meeting wanted to act on the article.

Steve Grossman, 139 Washington Street, explained his situation to the group.  He would like to move his HR business into the location.

Paul Masciarelli, 15 Maxwell Circle, expressed concern regarding how long Mr. Grossman would be there and what the next owner would do.  He also expressed concern with the Brook’s/Tuck’s property.  He feels that this change will give the owners the freedom to do what they want on their property.

Colleen Cappucci, 281 Washington Street, stated that she agreed with Mr. Grossman that the property would be difficult to sell as residential.

Alison Hay, 11 Maxwell Circle, indicated that Mr. Grossman knew what he was getting when he bought the property.  She also expressed concern regarding the traffic issues.

Bonnie Hamlin, 13 Maxwell Circle, read a statement from several abutters regarding the clearing of trees, reduction of property values, pollution, drainage and visual appearance.  She stated that they would protect and preserve the environment.

Bob Scanlon, 9 Maxwell Circle, indicated that he had a conversation with Tom Kelleher of the ARRT.  Mr. Kelleher was unaware of the proposal and has some concerns regarding the impact of the rail trail.  He feels that is the most beautiful section of the trail and commercial development will negatively impact the trail.  He would also like a traffic analysis done.  He feels there are too many impacts that are not being reviewed closely.  The Town needs to look at the whole picture.

Sandi Austin, Law Offices of Arthur Bergeron, asked if the article could be modified.  She was told no.

Mrs. Hamlin asked the Board members to indicate how they would vote.  All the members stated they would vote no but would consider passing over.

Barbara Masciarelli, 15 Maxwell Circle, handed out an aerial photo showing the area as it exists with a buffer between the residential and commercial activity.

Len Daeke, 14 Maxwell Circle & Finn Andresen, 8 Atherton Road spoke in support of their neighbors.

Bob D’Amelio, seconded by Dirk Underwood made a motion to close public hearing.

5-0-0, unanimous

24 Coolidge Street – Site Plan Review
Present was:    Brandon Ducharme, Ducharme & Dillis
                Brian Lafferty, Empire Management Corp.

Rodney Frias recused himself from the Board

Mr. Ducharme presented the plans to the Board.  The applicant would like to construct two areas for vehicle parking storage.  The ITC has reviewed and signed off on the plans.  The Conservation Commission/DEP have reviewed and signed off.  SEA Consultants had reviewed the wetland issues and drainage for Conservation.

The Board sees no major issue but would like SEA to review the plans to confirm that they are the same plans approved by Conservation.

Sante Parente, seconded by Rodney Frias, made a motion to continue the public hearing until April 18, 2006 at 7:30 pm.

4-0-0, unanimous

Rodney Frias returned to the Board

Quinn Estates – Definitive Subdivision Review cont.

Tom Collins, seconded by Dirk Underwood, moved to continue the public hearing until April 18, 2006 at 8:00 pm.

Vote: 5-0-0, Unanimous

Adjournment

Dirk Underwood, seconded by Tom Collins, moved to adjourn at 9:00pm.
